In that book I read, the innocent men who got released after DNA proved their innocence never get any letter nor formal apologies from the state, the police, the lawyers, nor even the judges.

Nope, that only happens if they bring a civil suit against the state after they are released.

They did bring a civil suit against them and it was settled out of court. Still no apologies to those men who spent at least 8 years on death row for something they didnt do. Scary, isnt it?

Absolutely. Especially when the conditions on death row are what they are. Not only have they had 8 years of their life taken away for something they did not do, they likely will suffer some lasting mental health issues for a lifetime.

And the justice system, if functioning the way it is intended, is supposed to be free of bias. That is not to say that the judges and lawyers do not have personal bias, but that they cannot allow it to affect the deciding of sentences and cannot use it as an excuse for not providing effect legal counsel. Unfortunately, it occurs far too often, and is an outright violation of right of due process.

I find it a bit odd, if you are working within the justice system as you implied with that "we have a saying", that you don't know that its called a gavel. Gravel is something you put on the driveway.

Unfortunately the justice system isn't free of bias especially in smaller communities. Secondly, some communities strictly enforce the laws than other communities. Example: If one is caught with 1/4 of marijuana in a bigger city, most of the time, you wouldn't be bothered or a small slap on the wrist. Take the same scenario and put it in a smaller community. You will be in jail for a long time.

You say judges cannot play favoritism?? Then explain the golf buddy syndrome? Some lawyers hope for a certain judge simply cause they are close to the judge or that judge is lenient on certain crimes. And POLITICS plays a huge role in sentencing in a voting year.

Especially if one contributes to a judge's re-election. If you ever get in trouble, it doesn't hurt to call it in.
 
Exactly. Decisions have often been made, and plea bargains agreed to between judges and lawyers before the defendent ever appears in court. Waht do you think is going on in judge's chambers prior to a hearing? They aren't back there talking about the weather.

The judge would likely be working on other case. The system is overwhelmed. Why do you think that it takes two years to settle a MVA claim?

Quite simple...the ineffectiveness of the legal system.

It is more dependent upon the race and SES of the defendant than it is on the amount of marijuana possessed. And marijuana has been all but decriminalized under Federal law. So possession of 1/4 oz. isn't going to warrrant a lengthy prison sentence in any community, large or small. However, a black man caught with a rock of crack cocaine will do twice as much time as a white upper middle class man caught with twice as much powder cocaine. Why? Social construction of drug laws, and inequities in sentencing procedures and legal defense.
 
You got that right Jillio! It is sadly a racial thing at times and social economic statuses.

As for having to call in contributions or whatever else, in a such a fair system why would we need to?
 
It may be easy for all of us to say this, when we haven't yet walked a miles in her son's shoes. This is the mother's worst nightmare to see her son in a place like this when he is innocent.

You think everyone gets a fair trial, I would think again if I were you. be very glad it's not you in there.

That´s why I don´t support rape staturary because it could destory teenager´s life when they did not force each other for want to have sex or whatever... They should focus REAL sex predator/sex preverts/pedophiles who forcesto have sex with anyone or seduce children.

Why is the brother helping his sister urinate? That should be the responsibility of the parents not the sibling!

I can see why he was charged with incest and rightfully so.

Have you spent time trying to make arrangements for interviews, meetings, trying to collect evidence, testing DNA--which takes time, etc.?

Once you have experience the above, then you will understand that it takes time.

Afterall do you want your lawyer to come prepared or not when you have your day in court?

You also have to look at one's record, if they were on probabtion or not, as well as outstanding warrants.

All does add up for additional prison time.
