Peterson Judge Reschedules Penalty Phase

REDWOOD CITY, Calif. (AP) - The judge in the Scott Peterson murder trial denied defense motions Monday for a new jury and a new venue for the penalty phase of the case, and rescheduled the process to begin Nov. 30.

The penalty phase had been set to begin Monday, 10 days after Peterson was found guilty of first-degree murder for killing Laci Peterson and second-degree murder for killing her fetus. Jurors must choose between a life sentence or execution.

"We're going to have to go with this jury," Judge Alfred A. Delucci said in rejecting the defense arguments.

Defense lawyer Mark Geragos argued that a new jury was needed because the outcome would be tainted by the ousting of two jurors during deliberations and the outpouring of community support for the guilty verdict. He noted that more than 1,000 people cheered outside the courthouse when the verdict was read Nov. 12.

"This court knows the atmosphere surrounding the courthouse as the cheering section ... charitably described as a mob scene, obviously cheering the fact that the jury reached the verdict that they did," Geragos argued. "I fully expected people to start building the gallows somewhere in the parking lot across the street."

"Any lingering doubt they (jurors) may have had essentially is extinguished by the cheering masses," said Geragos, who wanted the penalty phase moved to Los Angeles County.

The judge said moving the case elsewhere would be impossible. "Where could I send this case in the state of California that hasn't been inundated with the media coverage?" Delucci asked.

Prosecutor Dave Harris argued that there was "absolutely no showing" that this jury had been prejudiced.

The jurors are expected to hear testimony much more laden with emotion than they did during the five-month guilt phase of the trial.

The penalty phase is like a miniature trial, but absent most of the typical rules of evidence. It allows jurors to hear pleas for leniency and heartfelt recollections of the victim.

It will begin with opening statements from both sides, followed by testimony from friends and family members and closing arguments, before the jurors are once again sequestered for deliberations.

"Witnesses are pretty much allowed to say whatever they want," said Robert Talbot, a University of San Francisco School of Law professor who has observed the trial. "Laci's family will be talking about the impact on their lives without Laci there and not having a grandchild. The Petersons are going to attempt to show there is something of value in him that shouldn't be destroyed by the death penalty."

Talbot said defense lawyers also are allowed to "argue lingering doubt," playing to jurors who may still be somewhat uncertain about the prosecution's case.

I'm glad the judge denied the motion for a new jury...so I guess we'll have to wait and see if Scott Peterson gets the sentencing he deserved.
 
That's true--it costs money to shelter and feed the inmates, but it COSTS MORE to have them executed.
Life imprisonment is cheaper than execution.
I will keep saying this until it sinks in.

I never know that it is more expensive than life imprisonment... I guess I learn something new from this topic.

Yeah, me too. I am perplexed because spend $$$$

1. ) Food

2.) Electricity

3.) Heat

4.) Staffs

5.) water

6.) entertainment

7.) etc.. etc...

Scott should not be into anything entertainment like weigh lift, watch TV, outdoor, etc...

He should be in cell with NO windows rest of his life !!!
 
This is NOT AMERICA! i have heard about 50 years ago. True american ended the early 60s. This man is somewhere and hes proud to see what america as it is today.

I just don't understand how an execution could be much more expensive than housing a prisoner for life? *scratching head* I mean, once the prisoner's dead...no need to pay for his/her needs in prison, etc.

BTW, I'm glad that Scott Peterson was found guilty -- I was beginning to think, 'Oh no..this may turn into like the case of OJ Simpson when his ex wife, Nicole, and her friend, Ron, were murdered in 1995. :roll:
 
I found out today on the news that Scott Peterson jury decided that he deserves the death penalty for murdering his pregnant wife, Laci and her newborn.

Think about it, He lost his wife and his child; it didn't seem to faze him. While that was going on ... he is romancing a girlfriend.. He screwed up on that part. tsk tsk. :nono:

I asked dad to explained that you are absolutley right the demcrats they covered thier ass and blamed on replublicans . If replublicains makes a mistakes they tell the truth thats why they get blamed. Why becus they re telling the truth and democrats dont so therefore its why gay lesbo favored demo. PERIOD . I which everyone would understand the difference.

I hope ether arnold swartzenagger give scott peterson a pardon. Or the california supreme court overturns the death sentence and reduce the sentence to 50 years. That means he`ll get a parole hearing in 10 years.

What does being pro-choice or Pro-life have to do with the death penalty? They are entirely different. It's true that some people who claim to be pro life also support the death penalty, but it's also true that some people who are pro choice support the death penalty as well.

As for Cheri, I'm gonna let her answer your question if she chooses to.

Parole was not an option. The choice was death, or a life sentence with NO parole. Same with Charles Manson. Even when his death sentence was commuted in California, he got life without parole.

I don't really know, but I would guess that it has to do with the appeals process. When a defendant gets sentenced to death, his sentence is automatically appealed. First, on the state level, and then, when the state appeals are done, the case goes through the federal appeals process and this can take YEARS. In California, is can take DECADES before a defendant's sentence is carried out.

Yea, they found him gulity as death row. Now wait till Feb 25 (if i am right about date) the judge will decide what should he get death row or other. Geez, wait another 2 months to find out from Judge. What a Waste!
