To me it almost looks like he is hitting the scooter. I am assuming the subject is still lying on the ground??? Doesn't look like he went low enough to engage someone on the ground.

Yeh, like I was saying earlier. It doesn't look like the guy is actually being struck upon from personal anecdote, both the force required and the trajectory of the baton are noticeably off. In forensics we confirm this by measuring approximate heights of existing objects in the photo, we spend hours on a pictured known object in the photo, and get actual dimensions, mark it out, then measure what is known about the rest of the photo. It will take awhile to do the real work on this, but I am not interested in that enough for now. :P All it would take is a recording, statement or such given from another party to confirm whether it happened or not.

But Alex's got a point, this guy rose his stick. There is no doubt in that. In a world of Minority Report, he woulda been arrested on the intent of the crime. :P

i guess the rest of us were imagining things when we talked about that cop striking with the baton. and i guess it's all a lie that that guy is now in the hospital being treated for facial injuries.

Show the strike from this video....just one. Simple pause and screenshot. Heck I want to see where the baton of the officer from the 20th second came within 2 foot of the guy. It didn't happen

i don't see him aggressively resisting arrest at all, he was lying on the ground trying to get his foot out from under the scooter after the cop moved that scooter over his leg when he was suddenly pounced upon by a number of cops, one of whom swung a baton.

If you prefer to think this guy, a lawyer, is faking it all and that that baton was a piece of foam being swung just to hit air, then ok.

The truth will come out soon enough.

You do realize if the scooter was on his leg it would have turned over from his moving around don't you? :lol: And how exactly is the kickstand reaching the ground if the scooter is on his ankle?
 
just ignore the occupation. winter is around the corner and they will all go home. no need to abuse. just use patience.
 
Charleston had it's occupy day today:

Joining with people from around the globe, 170 people -- marching in three separate groups today -- joined "Occupy Charleston" for the first local display of the protest that's growing for weeks.

According to Charleston Police Department spokesman Charles Francis, the march started at noon at Mall Park, marched to Marion Square via Meeting, Mary and King Streets, then continued down Meeting to Washington Park. The groups then met for five minutes and dispersed. The march ended at 1:30 p.m.

"Everything was fine," said Francis...in Charleston, plans were already hatched for an "Occupy Brittlebank Park" starting Wednesday.

Yeh, I don't question the backstory of what is going on. The protest are going on for a reason, and it's clear the hype is not made up either. People are distraught and there is a mob mentality going on over the social unrest.

I am focused on the actuality of the given evidence so far as to whether the vic was actually harmed, or struck upon, part of that is what interests me in the subject.

Took some image stills and looked at the frames separately, but it's still hard to see whether the observer was actually crushed or not, because the recording moves around too much. In just one moment he's not there, the motorcycle is still, one second later he's already on the ground.

It seems like the officer who rose the baton may not have hit the target. But I understand that may not be the point though. Check out the image stills. the direction his eyes and arm are moving are not exactly 100% parallel towards the subject on the floor, unless he was hitting extraneous of the guy's body.

I also uploaded a gif, but it seems the free hosts botch the framerate to make it faster than it actually is. So I had to resize, re-edit and manually set the fps to 10 per second. You be the judge, see it:

Now if we debate via the 'attempt to injure someone' was there, same concept with an officer drawing a gun = intent to kill, it's clear this LOE loses this in this light. He is no saint.

Thanks for the hard work. Seems to show exactly what I said... a) the baton decelerated and B) the baton never reached the ground or even close. To me it looks like an attempt to intimidate....given the way the man was acting I would say that was appropriate

This was the first time I've seen the video. I agree the Darth Vader cop made no attempt to strike with the baton, but he broke police policy in attempting to intimidate with it, know what I mean? The baton is like a gun, it is all or nothing. No biggie, even cops are human.
And btw, how would you know "the way the man was acting?" He is completely out of sight to me. You mean acting below the cop? Was he refusing to quake in fear? What? Inquiring minds would like to know. :P

At :18 you can see both legs moving freely under the motorcycle while it is stopped. How could there still be any doubt?
