And the plain fact of the matter is, if people were not insisting on texting and driving, the law would never have been considered as necessary to stop the activity. Unfortunately, there are still those, that despite the fact that the law clearly communicates that texting and driving is dangerous and illegal, continue to do so. That is why the law is necessary. Because people insist on acting irresponsibly no matter how many times they are told that texting and driving is dangerous, or talking on a cell phone and driving is dangerous.

that doesn't answer my question. We already have Reckless Driving, Vehicular Manslaughter, Careless Driving, Failure to observe traffic lanes, and several more. Guess that's why many states do not adopt it. Guess they have better common sense than this.

And none of those cover texting while driving. One can be charged with any of the above in addition to texting while driving which adds greater culpability for the one causing the collision. They could also be charged with all of the above in addition to texting while driving.

If people had common sense, they would not be texting while driving, nor talking on a cell phone while driving. Then the law would not be necessary.

again - Reckless Driving, Vehicular Manslaughter, Careless Driving, Failure to observe traffic lanes. Those carries with hefty fines and penalty. DWT does not. It's just a mere $100 fine. I guess that's not an effective culpability. That explains why the DWT statistic is still increasing. :roll:

If you cause an accident, and are charged with DWT along with another charge such as Vehicular Homicide, it most certainly does increase culpability. :roll:

The charge Vehicular Manslaughter alone is already serious enough to land in you in jail for a long time. DWT is just a mere $100 fines. We've sentenced people to jail for doing stupid thing with cars without needing those little laws.

While the texting law may be a good idea but at the same time, there should be more accountability before such thing should be occurring. Sometime we just can't prevent such stupidity because it is already there front of our eyes.

You do realize don't you, that a sentence can be increased based on extenuating circumstances that would increase culpability? Therefore, the sentence for Vehicular Manslaughter would be longer in the case that the individual was found to have caused a fatal accident as the direct result of DWT.

you do realize that the judge can make a ruling based on police reports at that time when DWT didn't exist?

Exactly. We cannot prevent what is already occurring. It is already happening and there what has to be dealt with is what is. The only way to hold people accountable for what is already occuring is to have consequences in the form of punishment from laws.

Its like, you can tell your child not to throw a ball in the house, or they will break something. They catch you not looking, and they throw a ball in the house, it hits the candy dish, and knocks it to the floor. Well, you tried to prevent by telling them not to throw a ball in the house. They did anyway. You can't prevent the candy dish being broken, because it is already in pieces on the floor. What do you do? You punish them for breaking the rule, and for damaging the candy dish.
