You have no clue or idea how workers compensation works. It is not what you think it is. Once you going though like this, you will have completely different perspective. These (Carrier) attorney will DO ANYTHING to get out of court, just anything, make up BS whatever. Happened to me, so I know what it is like. I won the case because, the damage is done, whatever I do afterwards means NOTHING in my case. I have done construction work while on disability leave, the carrier attorney blamed construction job that I had and believe I had an accident in it which never happened. There was no such accident on construction job. Anyway, because of this I was able to prove that my last job was the cause injury and construction job have nothing to do with my injury. It was rather long story, 3 years of battle.

There are cases where it is not bright thing to do if do NOTHING but sit at home. It will cause one unable to prove anything.

According the link posted about the lawsuit , it's still going on . And if you're a middle of settling a lawsuit for an injury you don't go around knocking huge rocks over. It's not the brightest thing to.

Your reasoning is (I think) that rocks have little value. If they were manmade into a building, and these guys bulldoze the building over, they are just having fun, yes?

If these guys started Sequoia NP on fire because they find fires to be fascinating, they should be allowed to roast marshmallows, unimpeded, yes?

If they found ancient drawings in a cave, they are allowed to draw beards on them, yes?

The thing is, these rock formations had value. The other things to consider here;

  • Guilty? Of what? Wait until the trial.
  • Even if convicted, their lives are hardly ruined until sentencing. They might get off with a fine or probation.
  • The rocks are sentenced to a million years of becoming worthless.
  • The future visitors to the park are sentenced to a less-fulfilling visit.
 
One other thing about the laws here, they are made to deter idiots like this. If it was $200 fine for damaging park property, it would be done much more frequently.

That is incorrect. my reasoning is that rocks have NO value separate from what man gives them. and to value the position (standing on each other balancing) of an inanimate object (rocks) over the life of a breathing living human being is nuts.

Your value of something differs from mine. Maybe I LOVED those rocks in the formation they were in. Maybe I paid taxes to keep them in that formation for my son to see. He can only see them in photos now. Same for countless other people.

Those men knew what they were doing was foolish and wrong, but proceeded to do it anyway. We have laws in place to prosecute them. Do we overlook this act of "boys will be boys" same as we do for most traffic violations now? No need to make laws if people refuse to obey them, and our LEO and courts do nothing to uphold and enforce them? Why bother, the rocks are already dead?

I wonder why they moved with their village close to the mountain which has volcano. It is the same in California where the homeowners put their homes on the cliff and that caused mudslides. They don't think about their safety in the first place. :hmm:

Hoichi, you are the one who posts here the most about the not value rock. Here in the Southwest especially in Utah, we have red rocks and red landscape. It is sooo beautiful to look and see what make the formation so great. We, Native American, have a lot of respects for Mother Earth. The rocks are living and we were careful about taking care of our Mother Earth. Same with caves where there is pictographs on the walls that Native people drew to tell our history about animals and some about wars. They are precious and well taken care of. We can only look at it but not touch them. The boulder that was standing on top of rock has been there for centuries. They should have not touch it in the first place. It is natural the way it is. The boys or men if they are called as men should have report to the Rangers about it and asked if they can topple it over as it is getting weak. If not, then don't touch it no matter what. Other formations are there to be awed and admired in showing respect to nature. Red Earth which is found mostly near the mountains or part of the mountains are really awesome and they are incredible when the rocks including the boulders made formations which the former rivers (no longer there) had made them look like that.

It is the same with the Badlands in South Dakota where whites took away from Lakota and Dakota just because the miners or the prospectors wanted to find gold, but then never gave it back to them. The Lakota and Dakota view the Badlands as sacred and want to worship with their Medicine Wheel and also to carry out their own ceremonies. They are fighting to get that back, but the white people refused to give them back. They are still working on it. :(

All I have to say to you here is to show respect for the Red Earth. It is value.

May Grandfather Sky watch over Mother Earth. :(
