Martial Law overrides that. The Constitution actually allows that exemption - Article I, Section 9 - "The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it." Your LEO will actually enforce it if Martial Law has been legally declared. So... what would ya'all do?

do the stand-off and hope they'll just go away? or comply? or fight to death?

What did the NOPD did were so wrong when they have to take the weapons away from law abiding citizens. So unconstitutional.

I don't think New Orleans had any rebellion against federal, the scumbags are just the criminal.

yes what New Orleans Mayor and New Orleans Police Chief did were illegal. 3 years later - the federal judge issued an injunction and declared their action as unconstitutional. but then - that's post-disaster.... 3 years later....

so what about "now" when the officers have arrived to confiscate your guns? would you get in shootout with them?

Well, I know the LEO's in my area. I also know some military. They are in favor of the right to carry. They have publicly stated they will not seize weapons in the event of an emergency or disaster. It became a hot topic after Katrina.

The only time they would seize weapons is if a law were broken. Also, the politicians in my area are all hard core right winger and pro 2nd amendment.

But .... if I was in that situation, I would cooperate only if they had a warrant unless I felt me or my family were under a threat - then there would be no way they could get them from me. I would be guilty of civil disobedience. Its my private property they would be "stealing" and that is how I would view it.


I will have to look up the statutes, but you have the right to protect yourself from unlawful search and seizure. You do not have to consent to a search of your premises. You even have the right to protect yourself with the appropriate force from an unlawful arrest - but you had better be 200% sure you are in the right.

I would not have a shoot out with the police. The one's in my area are on "my" team.

But ... I think you are referring to rogue LEO's? that is a whole different story.

So, my backup plan in case of SHTF is to have plenty of canned foods or MREs (if available, MREs has very high calories.), take a couple of weapons and plenty of ammo with me, take my truck (if EMP doesn't happens in my area), probably take 10 ten-gallons of jerrycans (if possible), and of course, my dog.

Well, there are lot of ifs, so, let's hope it won't happens to us all in near future.

Or would you make a run for it immediately?

I can't think of a worse scenario than being surrounded by a gazillion scared, panicking people. If in the inner city, I would leave via sewer tunnels if I could.

Oh, I won't shootout with them, I'm sure they have the bulletproof vests on them, there are deputies in my town that wear the bulletproof vests.

Okay, so, what I'd do, I'd hide them that a deputy hopefully didn't think of a place. Something unusual place for the cops to look at.

Storm and sewer tunnels, that's all I can think of. I bet those tunnels under the city are like a little mouse in the large maze, it'd be best if you have a compass and map.

problem is - some states have a list of who owns what guns and how many guns like NJ. I'm required to apply for permit for every time I want to buy a handgun. So they would probably tear my house down just to find it.

In Georgia there is not a requirement to register guns. You do not even have to provide SS number when buying one.

That's why you might want to keep at least one gun elsewhere.
