Overtime pay or no?

Good example OSHA that is run by government, where if companies have dangerous working conditions, OSHA takes over and punish companies and enforces the safety codes. Union back then, like Homestead steel mill strike, employees down there organized after Frick (The CEO of steel company was ruthless and don't give damn about safety of employees. That was before OSHA was formed by Uncle Sam. There were machines all over without safety on it and if your trip, your DEAD period, and Frick don't give damn about it. Frick mistake was to allow private cops shooting employees where most of them don't have guns to protect themselves. Outside the mill, though media whom called the Pittsburgher was outraged over this, Andrew Carnegie fired Frick, thank god!
Will OSHA protect workers from unreasonable termination? HA HA!

Same for my SIL. He works rotating shifts, four days on, three off, regularly. Ten hours per day is considered the regular work day, and is not overtime. If he has to work more days (because one of the other guys is sick or on vacation) then he does get overtime pay for anything over 40 hours per week.
:yesway: That's reasonable so it's not illegal.

My girlfriend would work 4 days---NO weekends. She used to have Thursdays off, but now it's Tuesdays. Either way, she has the 40 hours. Never 4 straight days for 40 hours. I would suppose work plan it so that no one works 4 straight days of 10 hours each. I kind of wonder if anyone at her work works 4 straight 10 hour days, but I doubt it.

Besides, there's another organization called EEO. It protects workers from discriminations. Usually an union tells a member to file a complaint to EEO when it suspects an act of discrimination by management.

Does a person have to be a member of union to file with EEO or can a person file depsite not being an union member?

It's not up to employees but up to management. Is she new? If so, then she's part-time FLEXIBLE (PTF) which means that management can change her schedule as much as they want. Same with USPS, new employees are called PSE (Postal Support Employee). Management schedules them when needed. There are few PTFs working now and they will become FTR anytime soon as long as their attendances are good. BTW, finally those PSEs are covered with health insurance never like before.

SHe has been there for about 4 months so far up to this point.

So she's damn new. I suggest that she re-read all paperworks that she got on the first day.

HOWEVER, she should get a lawyer for no OT pay or file a complaint to EEO if she suspects that she didn't get her OT pay because she's deaf which is one of two possibilities. Sometimes managements think deaf people are dumb and think that they can get away with this kind of incident.

OSHA got nothing to do with unreasonable termination, if unreasonable termination, contact EEOC and attorney.

OSHA is for workplace safety.
Right, as long as an employer terminates a worker due to disability, race, sex, age, etc.

For example, I worked for 28 years and one day I was one hour late for work and then got fired, that's unreasonable termination. Can EEO help? No, but my union can.

Here in DE, the electrician's union has pushed for the state lawmakers to make it illegal for any person to do any hired electrical work in the entire state unless they have a valid electrician's license. 90% of all licensed electricians in the state belong to a union.

A few lawmakers were swayed, and passed the law. The end result? More money for the union, especially when the state mandates that all electricians doing government work are required to pay all workers a minimum of $47 per hour, no matter what they do.

I've applied for work at a few places that are controlled by unions. All refused to hire me, as the only way I could get in is if another union member recommends me, but I would have to join the union first.

I've been harassed by union members at job sites. So, I don't care if this offends anyone...my opinion is, fuck the unions. They are the number one reason business owners decided to ship jobs overseas, and they don't give a shit about their workers, just their money and the ability to control the workers. Like diehardbiker says, there are plenty of other organizations to help protect the workers.

If you are not happy with labor culture in Delaware so you have other option - move to southern states like Mississippi, South Carolina, Florida, Texas, Alabama and other states that where union is very weak, and you don't have to join the union because of right to work law. The harassment by unions are illegal under federal law and you should sue them.

If business owners ship jobs oversea because of unions so they should move the jobs to southern states, but most of them did not, rather goes with China instead so the union isn't reason because they want to get away with labor regulation, taxes and work safety enforcement.

If you want full work protection, so the union is only option for you.

Care to explain about what picture means to you?

I usually see people whoever don't like union and they rather to take any risk over the work protection, so it is their choice.
