No, online poker isn't illegal.. USA is taking action against the poker sites on bullshit charges for various reasons to make it hard for the poker sites to operate in the USA. However, it is not illegal for people to play online poker on the sites who still allow USA residents play on them despite USA's crackdown. Heck, I still play online poker for money.
EDIT: However, real money online poker is illegal in few states such as Washington and Illinois. Ironically, those states have casinos, and lotteries. The majority of states in USA don't have anything that makes online poker illegal.
No, it is NOT illegal. There is zero federal laws against online poker, only few state laws. I guarantee you cannot come up with a federal law declaring online poker illegal anywhere.

Actually the sites are located outside of the USA which is why they don't take out taxes on the winnings. It is the players' responsibility to report their earnings. The actual reason why USA shut down the poker sites, is to form their own and have their "piece of the pie".
You refer to the states law. This is very vague as there is 50 states. I stated earlier that the majority of the states don;t have any laws against online poker except for few.

They didn't declare it illegal to play online poker. They charged the poker sites with bogus stuff such as bank fraud, money laundering in order to control the traffic to the major sites. They did this in order to set up an USA regulated gambling site. They had no chance competing against the site giants.
None of that says it is illegal to play online poker. Read it carefully.

WOW!! Reading comprehension FAIL here.. It doesn't say it's illegal to play online poker for money. Only to run an online gambling business - there's a HUUUUUUUUUUUUUGE difference there. The risk is on the owners' part to open service to USA residents.
