It would depend if the facts fit the situation as per that state's laws. I don't know what those would be.
I'm guessing that a peeping Tom wouldn't normally take his child with him, nor would he report his own activity to the police.
I can tell you though if the rolls were reversed he would be charged, not her.
There are a lot of unknowns why she was there, what she was doing IN his yard at 5:30.. Beside up tight prudes think of nudity as sexual... and it's only sexual if you teach your child it is... If you don't want to see it... don't look, do not have someone arrested because they are nude in their own home.
He was not standing there with the door wide open posing... he went and got himself a cup of coffee.
I am a naturist.. I have seen so many naked bodies... young, old, kids, adults, big, small, great looking, ugly... Nothing sexual... simple nudity.
We shouldn't have to put warnings on our houses that say "Warning: Maybe Nude inside" Nudity should not be a "warning"
If someone sees nudity as a sexual thing... that is their business... but don't impose on others rights to be nude in their own homes.
what if he purposely exposed himself from his own home? It is illegal to be exposed in public area but not in your home. He probably thought he's clever by being exposed to public..... from his own home.
Like I said, there are a lot of unknowns here... but given the information that we have... it sounds more like a trespassing issue rather than... he wanted to expose himself.
I know there are silly people up and about at 5:30am, but what was HER business being at HIS house at 5:30am?

Perhaps to get to school bus stop. It's pretty common for people to cut thru neighbor's yards in suburb where houses and yards are right next to each other - not separated by fences. If you are really peeved about people trespassing on your property - you'll have to put up the "NO TRESPASSING" sign and a clear line of your property such as fence.
so the question is not why were they trespassing on his property.... not why is he naked.
The question is - did he PURPOSELY expose himself?
I'm naked in my home all of the time.
I sleep naked... when I wake up.. I go to the kitchen naked...
It's my home... I'll be naked if I want.
It's my property, I shouldn't have to put up a sign to have them know they are trespassing.

btw - you don't reside in NJ, don't ya? You reminded me of this craigslist ad for roommie saying that he's looking for a roomie but stated that he's a nudist so the roomie has to be comfortable with that.
Let's just hope he wasn't doing the helicopter in front of the window.
