Still fired. I think contracted employees get drug tested more than regular employees, because of their status. Not sure on this, though. I'll have to check up on that.

As to that, I am not sure. I'm not a hacker, so I wouldn't know. I just know that drug offenses aren't taken lightly.
Alright, this thread is about the hackers who committed a cybercrime (they shut down the websites without authorized access). Get it? If so, then what should the government do with them if they are caught? If the government is interested in having them working for the government but they fail the drug test, should they be prosecuted or not?

My guess? They might have their history already, and might know if they have a drug history or not. If so, then they may or may not have limited options. I could also be entirely wrong, and not have a clue as to how they do things.

Oh well, as a matter of fact, some hackers go to jail. Haven't you read news about them in the past?

Yup. One is in federal prison right now, serving a 10-year sentence just for that alone. He is the only person serving a sentence that long for hacking. Hacking crimes usually call for 5 years, but not this guy. He did some terrible things, which is why he got 10. He's in Terre Haute federal prison.

Therefore they were prosecuted and were found guilty. In other words, Foxrac's statement is not true. That's my argument. Jiro doesn't get it.

If DoD or NSA hires a hacker who committed a cybercrime to spy on other countries, I oppose it. The government shouldn't make a deal with them. No freaking way!

For example, if Sony hackers who might be NK lovers somewhere in America get caught, I, an American who pays taxes don't want to hear that the government needs them to spy on other countries. Those hackers, Guardians of the Peace deserve jailtime, period. Lizard Squad deserves the same.

Here's the thing, though. The US Government has already said that they consider the hack of Sony Pictures a national security matter. That's one thing. Hacking/attacking a game console does not have the same implications, nor does it have anywhere near the same level of priority as national security matters. Like others have said, hacking/attacking a game console is NOT high priority. What is high priority is national security. The US Government does have ways of dealing with that, some we know, most we don't. I say just let the cards fall where they may, and leave it at that. As they say, karma comes back to bite those who do bad deeds.
 
They don't. They would much rather put their hacking skills to good use instead of putting them in jail and making them hate the US Government. Working for the US Government as a hacker is far better then sitting in federal prison, broke and having a felony record.

Of course, they are done in secret matter and undisclosed.

nope! an employer is not responsible for drug-testing contractors or running background check... only their own employees. since an employer does not want to deal with it, they usually contract with an agency to provide workers. some agencies do not perform drug test. that's the whole point of hiring a contractor. you bypass a whole bunch of legal issues. if you have a specific requirement about a contractor working for you, then you look for an agency that meets your needs such as thorough background check, routine drug test, etc.

for example - a federal agent or US military is not allowed to torture a suspect/prisoner to obtain an information. so what to do? they hired defense contractors to do it for them. later, this method got leaked to public and that "loophole" was closed.

Hiring a contractor has its pros and cons. it's cost-effective for your business and less headache for you to deal with such as drug testing, background check, etc. cons? lack of accountability.... just like Enron and CIA/military

no. it wasn't about who they hacked that made it a national security issue or not. it was the method of hacking.

what hackers did to xbox/PS was not a national security concern because it was just a simple DDoS attack. but what hackers did to sony was very destructive and alarming. they obliterated Sony's payroll system and infrastructure and peek-a-boo in everybody's files. that alone can easily destabilize any major corporation.... or public utility...

not all hackers get prosecuted. not all hackers get a deal to work for government in exchange of avoiding being prosecuted. some hackers get prosecuted and then later get offered to work for government (well as a consultant/contractor since a felon cannot work for government) ok?

look at Kevin Mitnick. he's a felon hacker but now he consults for the government.

it really depends on who and what they did. just because you're a hacker doesn't really you're something. it really depends on each case. if a government is really interested in your method of hacking or your intelligence.... they'd want you.

some hackers refuse to work for government because they don't want to lose their creds among hacker community. or they're simply disgusted with the thought of working for "the man".

btw - there are 2 kinds of hackers - script kiddie and the real hacker. script kiddie is a person who uses an exploit program to hack a computer. a hacker is the person who hacks a computer with his own program/method. the government is obviously not going to make a deal with script kiddies.
