Family dream house become nightmare

I asked my daughter, a Realtor licensed in SC, about the meth house situation. She told me that if the Realtor was not informed of the house's meth lab history, then the Realtor would not be liable in a suit by the new owners. If the meth lab was disclosed to the Realtor by the seller, then the Realtor would be responsible for disclosing that information to the buyer. She said that's true for any potential problem because there is no specific law pertaining to meth labs. It would be the same for things such as knob-and-tube wiring, lead paint, asbestos building materials, etc. But people can be required to disclose only those things they have actual knowledge of. (Neighborhood rumors don't count as knowledge.)

Even "nice" neighborhoods can have meth labs in houses. In our neighborhood (not the immediate area but another section), we've had at least one grow house and one meth lab. The owner of the grow house still lives there, and the meth house was sold and has people living there. I don't know if they had the house decontaminated.

exactly as stated before about the meth lab and realtors. I have friends and family as well in the realty and Ive sold enough houses to know as well. Kind of useless arguing with some here since they are too lazy to do any research themselves, but they wont hesitate to argue either...lol
 
It sucks that inexperienced ones argues with experienced ones... It happens all the time. Thanks Reba!

It is very difficult to prove knowledge in the court without documented evidence.
 
In this particular situation, they may have a case against the real estate agent. It does seem unlikely that the mother wouldn't know about the meth problem.

Although his mother may well be the person that he most wanted to keep it from. The question then becomes was he successful or not.

On a personal level, perhaps he would want to keep it from her but I think she knew, and possibly even conspired with him for cover up.

He wasn't a kid, so the mom most likely already knew about his "troubles" and had probably helped him out of past scrapes by providing for lawyers and other enabling "support."

We'll have to see what the investigation uncovers.
