For you, it will be misdemeanor for you, unfortunately, maximum 1 year in jail and or $6,000 max fine. Your judge could decide if you get caught.

For me, if I get caught all I get is wrist slap! Along with $100.00 citation, and no criminal record.

Eventually, your state will give up after realizing it is costing them too much.

Depending on police officers, some are asshole - they can charge with felony if they could find evidence that warrant the felony charge as possible, also repeat offense can be felony too.

The criminal justice system in Alabama is horrible and jurors don't care about overcharge - police officers win. We have extremely overcrowded state prisons.

Not know about my state will give up, but they are too stubborn and don't care, unless their state prisons get massive break-in with numerous escapees or turn into bloody.
 
Sorry, I just checked your state cannabis laws. They will charge you felony *IF* you sell them, and you had prior drug conviction.

Simply to throw black and spanish in jail, have you wondered why so many blacks are in prison than white… Mind you, the drug usage between whites and blacks are not any different yet more blacks thrown in jail while whites just walks. Why do I think the drug law WILL change? The problem is everybody in political level KNOWS that these drug law has failed, and government has lost trillions of dollars without making any true dent in drug problem in our society. WHY they can't fix it? Well, they will at some point. BUT again why can't fix for years? It is because the law itself was written to make it illegal for ANYONE, even president to make change in drug laws, PLUS the law itself outlaws research and any kind of study to determine how safe cannabis is. It is illegal to do research on drug, don't you realize that… BUT there are studies out there by private proved already, but because of current drug law, government is NOT permitted to accept any of independent studies on cannabis, they (Government) are required by law to IGNORE completely. The drug law we have is pretty much iron clad, just like the Berlin wall, it WILL fall.

The issue right now is, who is going to break that law, President? Congress? DOJ?

I believe that DOJ has the power to declare this law as unconstitutional and can remove that law from the book.
 
Right, I didn't ignore your statement about prison being overcrowded. IT is what will lead to relaxing drug laws. It happened here in NY, they finally relaxed the drug law, bam! NYS now is closing some prisons after about 10 years of relaxing drug laws. You have to understand that it is ILLEGAL to have overcrowding prison, DOJ will get on Alabama politican's ass soon or later! Meaning they will have to look at which crime is causing overcrowding. It will be likely cannabis possession, they will have to make decision how to fix it, the only way is to decriminalize the potheads.

NYS once has the world's strictest drug law, called RDL as "Rockefeller Drug Law" and yes it caused our prison to get overcrowded in no time! Thank god RDL has phased out years ago!

Yes, I'm seriously hope so and I can't wait to see my state gets sued for overcrowded prison. It will be very expensive lawsuit for poorer state and they may end up with tax increase - very unlikely due to serious voter opposition and they can sacrifice the education or vocational funding.

I can't wait until voters become aware about how serious is broken government in my state after harsh spending cut in exchange for prison and court.

I love Texas gun law, I would move down there with heartbeat if they don't execute convicted felons down there. I don't want to be part of execution! Remember when execute a felon, it is the people of the state that is doing murder on felon. Not acceptable by me. "The people of (Whichever state) vs convicted felon", don't forget that.

I wanted to move out of NYS, it is because of stupid "Safe-NY" law. And even it is legal to execute a convicted felon up here, thank God, it rarely happens up here. I rather see convicted felon stuck in 5 by 7 foot cell room, jack off all he/she wants while the rest of cell mate watches them for the rest of life than having a pot head stuck in that same cell room wasting our money.

About few weeks go, what did President Obama said about Cannabis over Alcohol?

BTW, this is not my first time, nor even second time… I have known cannabis since president Nixon started the stupid war on drug and that is long enough for me to understand its effect. So, once again, its really safer with Cannabis than drinking.

Trust me, soon, Cannabis as illegal will be a thing in the past! Don't forget two states had legalized them, so far NO issues!

but it's still illegal and you don't live in either of two states.

And mine is about the same -- I did see it on my feed, but only from those who were posting videos encouraging people NOT TO PARTICIPATE. No videos of those actually being done. So my friends are being smart, too.

and Supreme Court can rule the law unconstitutional. and only Congress can remove the law without involving Supreme Court and assuming that the law wasn't unconstitutional. I find it quite silly that you believe the drug law is unconstitutional....... exactly on what ground?

but the point still remains.... you're willing to break the law. perhaps you should wait till the law has been repealed.

Guess what? I never been arrested, secondly here in NYS if you get arrested, they can't keep you in jail, UNLESS you have grow bunch of pot, with intent to sell, or trafficking.

Getting caught with 25 gram or less cannabis is considered personal in NYS, meaning NO criminal record, so I don't have to report to employer or write down in employment application. The requirement for report such crime in employment is any FELONY charges, not misdemeanor or lesser charges. Read the NYS marijuana law, you will be shocked. It is NOTHING really.

Seriously, if cops here in NYS finds you got a bag of weeds on your coffee table inside your house and if cop don't have warrant specifically weeds, they can't arrest you, PERIOD! Yes, I talked with cop, they said they can't arrest without warrant. Friend of mine had search warrant for bomb making, he got something else illegal, guess what happened? these cops report "Nothing is found" he came out clean. it was scumbag that false report on him because that scumbag was jealous that my friend got his girlfriend, stupid motive.

Montana, Wyoming or Oregon are better if you want zero gun control with extremely rare death penalty.

I think NYS doesn't have death penalty anymore. :hmm:
