Bill Signed Banning Smoking In Cars With Children

SACRAMENTO, Calif. -- Gov. Arnold Schwarzenegger has signed legislation making it illegal to smoke in a vehicle carrying children.

The bill by state Sen. Jenny Oropeza, D-Long Beach, authorizes fines of up to $100 per violation.

The measure adds to a growing list of smoking prohibitions in California, which include smoking in indoor workplaces and within 25 feet of a playground.

Oropeza said her bill will reduce children's exposure to secondhand tobacco smoke. A Harvard School of Public Health study issued last year found that secondhand smoke in a car can be up to 10 times more dangerous than in a home.

The ban takes effect Jan. 1.

Arkansas already have this law since July 1st, I believe.. but TJ's stepmother still smoked with my son TJ and her 2 kids in.. sheesh! she is stupid bitch.. should know better cuz tj is allergic to smoking.. grrrr...

GOOD!!

People smoke outside the train station FEET AWAY from the GIANT "No Smoking" sign!! Hard to believe they're all blind... The police do nothing to stop it even though IT'S ILLEGAL! :mad:

My wife talks LOUDLY about them to make sure they hear our ire.
 
Even though I am a smoker - I am glad for these laws although sometimes they are a pain in the ass.

Right now in AR you CANNOT smoke in the following places
Any public building
Restaurants that serve customers under the age of 21 (which seems kind of stupid since it is legal to smoke at 18)
Workplaces
Within 25ft of any buisness, restaurant, or public building
You may not smoke in a vehicle if there is a minor with you.
You may not smoke on ANY hospital property or long-term care facility property.
You may not smoke on ANY school property or within 25 feet of a playground.

Right now the only places you can smoke are in bars, cars by yourself, designated outdoor smoking areas, and your own home.
 
Are you talking like your friends who are underage smokers? Honestly, 99% of cops are not going to think anything of a carload full of young people who happen to be smoking - my first impression would be "Stupid college kids". But should you get checked at a road block - all you're rears are in trouble. Whoever is the one who is 18 will be the one charged with supplying tobacco to a minor - a felony in some states. On top of the ticket for smoking in vehicle with minors.

Get ready for the list to get longer. And once they are done violating the civil rights of the highest taxed population in the United States, watch your back, because they will start stripping another group of civil rights.

You say "violate civil rights" most people say "protect civil rights"... what about those who have to endure acrid smoke in public from inconsiderate chimneys? I guess it's their own fault for having asthma or allergies or not wanting their personal effects to stink or to ruin a dinner...

What about personal responsibility? Do you really have to be told it is illegal to smoke in a car with your children in order to refrain from doing so to protect their health?

And, smoking is legal. States receive tax money every time a smoker purchases a pack of cigarrettes...in fact more taxes than are received from any other good or service. If it is legal, then it cannot be prohibited at the same time.

What about choice? You have the right not to enter an establishment where there is smoking. If you want to choose a smoke free environment, then you have every right to give your patronage to smoke free extablishments. However, you don't have the right to forbid another from participating in a legal activity simply because you choose not to.

My livlihood depends on taking a train to Leeds every day. I am VERY GLAD England made it a CRIME to smoke at train stations! Every day I smelled of smoke. I just wish it was enforced.

In most of the United States discharging a firearm is legal provided it is done in certain predefined zones. Why should the discharge of a firearm -- a potentially deadly act -- be considered different from smoking? Clearly inhaling smoke is dangerous (It's why people cough!) and should be kept away from places where it is most dangerous to people.

Interesting on how the onus is placed on people who haven't decided to do smoke. Special rights indeed...

Bingo. Put in that context - its not right for a Christian President to prohibit the practice of Islam, no matter much bad media the religion may be receiving in recent times. The same thing applies here to cigarettes and the tax revenue it generates. Every year the tobacco tax is raised to generate more revenue for the states, not because they want it to become too expensive for the common people to smoke.

Even though gambling is overall banned in this state - we still have two gambling establishments that are big hits - Oaklawn and Southwestern race tracks where horses and greyhounds are raced for money. They wont close these tracks because they continue to generate revenue for the state.

they will never prohibit smoking - too much tax money would be lost.

It is not enforced because laws such as this are extremely difficult to enforce simply for the very reason I cited. Civil rights.

Once can hardly equate smoking and firearms. Are you aware of the fact that only 1 tenth of 1% of smokers actually contract cancer? The numbers are even less when looking at second hand smoke. And one does not develop asthma from smoke unless one is predisposed to asthma in the first palce. It is a combination of environmental and biological causes.

But my whole point is, when you attempt to legislate morality, you violate civil rights and create unenforceable laws.
