I would not shop there at all, I don't like the idea of business that penalizes customers for writing bad reviews.

I have checked their policy, and it was rather nasty. If you didn't order something from them and it got your house, there is catch if you refuse the shipment, you will be penalize for this. WTF?
 
If they sent something to MY house, I would tell them to stuff it. If they want to fine me, I'd say, "See you in Federal Court". Doing this against deaf customers pretty much amounts to discrimination (in a way), and they would lose big, if it ever came to that. However, that's why I check my sources first before doing business with said company.
 
Mark, this have nothing to do with Deaf or any kind of disabilities. Its general, applies to everybody and I think it is wrong for companies to bar anyone from making bad reviews about them.

I hope this couple wins lawsuit against this scumbag company, and I believe that this couple did nothing wrong but exercising their right of free speech.
 
That's my point. I agree, it has nothing to do with the Deaf, but I'm hoping that they've hired a lawyer who will sue their pants off, and I'm pretty sure that lawyer would complain to the FTC about their practice, and they would then be forced to change, because if not, the FTC can shut them down permanently. Simple as that (I hope).
 
Thanks to media, now I am checking on every merchant policy before placing orders with them, if they got arm-length policies, forget them not worth doing business with them. From my understand and what I read though this website policy, I couldn't believe they were very anal with them and see how they run their business and excellent red flags as ones to steer away from. Especially policy that prohibits customers from writing bad review... that is a FAT red flag for sure, cause they are hiding their true color.
 
One day they'll slip up and show their TRUE colors. They almost always slip up somehow, and then there's disaster control after the fact, and that itself is a big headache. Trust me-- they will eventually. I had the same thing happen to me with a phone store I used to do business with, and they showed their true colors as a store that played dirty and tried to trick me. A person who used to work there told me that they play so dirty he never wants to go back again.
 
I am surprised they can do that. Makes me nervous to order from a company I don't know about.
 
I would check sources first to see if they're reliable or not. If they have a good reputation, then go ahead. However, if they have too many negative complaints, I would avoid that business.
 
I want to leave KlearGear a negative review and make them sue me. I'll make them regret ever emailing me.
 
Good luck with that, and have fun if you do. Better have a fancy lawyer on standby (preferably pro bono)

I am not sure how a company made you pay for something you did not order. I heard of some company sending their magazines to people houses and they did not order them and the people did not have to pay for the
magazines. This happen to me once I got a couple of magazines I did not order and I called the company and told them to stop sending them as I do want them and I am not paying for the two you send me. That policy does not sound legal .
 
I don't think it is. That's why I said if they sent a product to this address, they could stuff it. I won't pay for something I didn't order nor did I authorize to be delivered to this address. If they do so, I could have probable cause to sue them for harassment, and they'd lose big-time.

That's not what happened. They ordered something and never got it. They probably tried to get their money back but didn't and that's why they gave them a review of having horrible customer service. Klear Gear robbed them, then tried to get 3500 out of them, then try to charge them 50 more disputing it. Over a $20 purchase. That's horrible, and reporting it to the creditors??? Hurting their credit when they were the ones who screwed the couple over in the first place?? That's just straight crazy.
 
Still-- charging $3,500 for one bad review? It's not legal nor ethical. If I were the owner of that business, I'd fire who done implemented that policy, and then haul it over to make it more fairer. Plus, I would also settle out of court, so not to incur high attorney costs, and possibly have an international incident. Whoever is the owner cares about nothing but making money. Idiot.
 
I'm sure that companies like this have a shipping department. I would think that shipping department would check the tracking # for shipping. I've shipped $10 items and got tracking # for them. It is possible shipping was detoured. That would have happened to anyone. It depends on how fast they wanted item. Maybe it was meant for special occasion and they missed deadline for that special occasion.

I'm also curious about how review was written? If writing a bad review, simply explain why the service or product was less than satisfying. Don't put down a company. Simply state that you would no longer do business with them or that you'll have to think twice about spending money with them.

If I was to steal $20 from a woman, what do you think a woman will do? I'm sure word will travel around world. Everyone would be careful about being around me. That woman was robbed of $20. It is just the principle of things. No one would want to be silent if they lost $20.

I'm pretty sure it was the owner that implanted the rule. I would be wrong. It usually starts from the top.
 
Who knows? Either way, the person is a jerk, and is a rip-off artist, plain and simple. If they ever offered me a job, I'd say forget it, cause I have NO interest in ripping off people. I like to be fair, and reasonable.

right of free speech? it doesn't apply to corporations. they never lost their rights anyway.

the corporations and ANYONE have right to sue/bar anyone from disparaging them. it's called defamation unless it's true. however in this case... it's ridiculous.

Michelman said these companies' terms are so "unconscionable" that a court will likely not enforce them, which often happens when a term is imposed on a party that has no choice but to agree to it.

on the other side... it also prevented merchants from screwdy customers looking to scam them or ruin their businesses.

I'm sure you've ordered a lot of stuff from amazon.com and I'm pretty sure amazon's policy is longer than the length of your arm.
 
That's bullshit. The non-disparagement clause was not there until 2012, even though it's illegal.

A listing on the Better Business Bureau site says that in 2012, KlearGear was displaying a BBB Accredited Business logo and an A+ rating that it had not received. The site no longer displays that logo.
