ALBANY, GA (WALB) - A woman has been charged in the death of her five-month-old fetus over the weekend.
It happened in the 700 block of Mobile Avenue, shortly after 8:00 p.m. Saturday.

Kenlissia Jones, 23, was charged and taken to the Dougherty County Jail.
Officials said she took an 'abortion pill' that she purchased on the internet, and went to the hospital after taking it.

The female fetus was about five and a half months developed, authorities said.

It was not immediately clear whether the fetus had been delivered or not.

The D.A. said that he will likely take the case to a grand jury, and it could end up being a case of abortion rights.

For now, Jones is charged with murder.

Yeah but why did she wait so long to buy it ? She only 4 more months to go and then she could had gave the baby up for adoption.

She may not have known she was pregnant until then...or she was scared and didn't know what to do and just wanted make the situation disappear...who knows

Georgia woman charged with murder after taking abortion pill

A young woman who took an abortion pill, resulting in the death of her fetus of 5-1/2 months, has been charged with murder in Georgia.

The arrest stunned abortion rights opponents and advocates alike.

Kenlissia Jones, 23, of Albany, Ga., was ordered held without bond on charges of murder and possession of a dangerous drug.
District Attorney Greg Edwards indicated he might send the case to a grand jury.

According to a local report, Jones reportedly took a drug called Cytotec that she bought online from Canada, then delivered the male fetus in a car as a neighbor drove her to a hospital. The newborn died a short time later.


Generic misoprostol, which sells for $35 a box, and the branded Cytotec, which go for $175, at a pharmacy in Nuevo Progreso, across the border from McAllen. With requirements that may shut down most abortion clinics in Texas, women in impoverished areas may turn to taking abortion pills without prescriptions or medical supervision

A woman doesn't deliver a male fetus--she delivers a baby boy. Note--"The newborn died a short time later." That was a newborn baby, not fetus, not stillborn. A live birth, no matter how brief, is a baby, not a fetus.

A woman faces a murder charge after the death of her five-and-a-half-month-old fetus she delivered in an abortion attempt.

Kenlissa Jones, 23, was charged with malice murder and possession of a dangerous drug. She was taken to the Dougherty County Jail.

It happened on Mobile Avenue, shortly after 8 p.m. Saturday.

Officials said Jones took an 'abortion pill' that she purchased on the internet, and delivered her five-and-a-half-month-old fetus while inside a car.

Jones' brother and family were stunned to hear the news.

"At that point we didn't even know she was pregnant," said her brother Rico Riggins. "And so my first real reaction was like, why she keeping it away from us."

According to a report, she purchased the drug, called Cytotec, from a source in Canada.

"Once she took those pills, from the way I'm understanding it, she was in a world of hurt for a while," Riggins said.

On Saturday night, a neighbor drove Jones to the hospital, but she delivered the baby boy in the car on the way.

The child died after about half an hour at the hospital.

"We lost what would have been a nephew for me. And everything. And then my sister," said Riggins.

Dougherty County District Attorney Greg Edwards said this case will likely go before a grand jury, because Georgia and federal laws will need to be explored.

It's the first time he has seen this kind of situation.

Meanwhile, Jones' mother and grandmother are grieving.

"We're coping the best we can. We're hoping we get a lot of prayers," said Riggins. "I don't want anyone to be mad or upset with my family. At the end of the day they are doing the best we can."

Jones was placed in the Dougherty County Jail without bond. She has another son who is just under two years old.

Riggins and his wife have been granted guardianship of the boy while his mother's legal standings are decided.

Georgia law states that no abortions are authorized after the first trimester unless it is performed in a licensed hospital, in a licensed ambulatory surgical center, or in a health facility licensed as an abortion facility by the Department of Community Health.

No abortion is authorized or shall be performed if the probable gestational age of the unborn child has been determined in accordance with Code Section 31-9B-2 to be 20 weeks or more unless the pregnancy is diagnosed as medically futile, as such term is defined in Code Section 31-9B-1, or in reasonable medical judgment the abortion is necessary to avert the death of the pregnant woman or avert serious risk of substantial and irreversible physical impairment of a major bodily function of the pregnant woman. O.C.G.A. § 16-12-141 (2014)

Bet to differ, Caz....the baby was 5 months and 1/2 months old...almost 6 months..... born alive....would have had a chance at life if she had not taken this abortion pill....

As per the article and the Law in Georgia...

And...if she wasn't "able to cope"...she should have done this before 20 weeks...she waited 5 and 1/2 months!....That's murder in my book.
 
when I was student nurse I was in ER young girl brought in sadly she was dead and in dish next to her the fetus and in the other dish was fetu hand..i swore after that I would fight every inch of my life for women have the rights..the young girl was 15

like in Irland Spain all the catholic countries they all come to clinic in UK...It set package fly over go to a clinic then driven over to place where it done fly back next day taxi included

District Attorney Greg Edwards outlined much of a statement he released Wednesday in a news conference. But he said that he would be open to any further efforts by police in the case.

Jones was released from custody Wednesday after agreeing to appear in court for a misdemeanor charge of possession of a dangerous drug.

"Ms. Jones had been charged by the Albany Police Department for the offense of malice murder. However, this morning, I dismissed that malice murder warrant after thorough legal research by myself and my staff led to the conclusion that Georgia law presently does not permit prosecution of Ms. Jones for any alleged acts relating to the end of her pregnancy," District Attorney Greg Edwards said in a release.


Prosecutors said she purchased a drug called Cytotec from a source in Canada over the Internet, which caused her to deliver the baby boy, who died after about half an hour at a hospital.


GBI pathologists checked samples from the baby Tuesday, after an autopsy was ordered.

Fowler said part of the need for the autopsy was to determine if the baby ever took a breath, which could help officially rule that a birth occurred.

As of Wednesday morning, officials did not announce any ruling on whether a birth occurred.


Jones has another son who is just under two years old.

In addition, Edwards said that fundamentally, the issues at the heart of the case are legislative issues, for lawmakers to define.

Georgia Law On Abortions


In Georgia, women have explicit immunity from prosecution for any unlawful termination of their own pregnancy.

In part, District Attorney Greg Edwards' statement also said, "although third parties could be criminally prosecuted for their actions relating to an illegal abortion... the criminal prosecution of a pregnant woman for her own actions against her unborn child does not seem permitted."

"Having researched the matter," Edwards said, "an overwhelming majority of jurisdictions confronted with the prosecution of a pregnant woman for her own prenatal conduct that ultimately causes harm or death to the subsequently born child does not permit such prosecutions."
