Went deaf because of physical abuse.

Bill Cosby is being sued over sexual abuse that took place well over 20 years ago. How they are going to prove something that happened so long ago?

Please, people, just because someone doesn't understand what is possible with science, with legal process,
doesn't mean it is impossible to prove something many many years later.
The bodies of people who died in middle ages are being exhumed today and the cause of their death is being discovered - for the first time.
So, yeah, Botts- I don't know what school did you go to, or if any, but everything's possible.
I am not saying in this particular poster case it will be done, or easy, or whatever - just that there is always a chance so it's worth trying..

Massachusetts Statute of Limitations - 3 years Title 5, Ch. 260, Secs. 2A and 4 from the above link.

But, curious... is personal injury the same as child abuse in the legal sense?

This is important to understand well:

What Are Tolling Periods?
Sometimes the statute of limitation is "tolled" for a period of time. When the time period is tolled it means that the time period is on hold and is not running until the toll period ends. This gives plaintiffs extra time to file the lawsuit.
- See more at: http://www.legalmatch.com/law-libra...imitations-by-state.html#sthash.oDp87lfv.dpuf

perhaps under this exception somebody who was a minor still may sue.

As for personal injury:

Basic Elements of Most Personal Injury Matters:
  • Prove that the person was careless or negligent
  • The negligence caused the accident
  • And the accident caused the injuries
  • Statute of limitations - the time limit when you must bring a claim.
http://www.legalmatch.com/personal-injury-lawyers.html

Unless you are a lawyer, you may not realize there could be exceptions, extensions etc to the laws.
that's why it's best to ask a lawyer.
In this case perhaps a lawyer who specialize in child abuse.

Fuzzy, have you read this whole thread? And were you unable to extrapolate why lawyers are just ignoring communication from the OP?

However, I am not talking all the time about precisely OP, but also in general terms about what is possible and impossible in such cases.

- perhaps you misunderstood me.

It could be proved, for instance if the siblings confirm this. also, there could have been other family members who knew about the abuse and are ready to testify, too.
So can neighbours, other friends and acquaintances who either witnessed abuse, signs of abuse or heard about abuse over the years.
If there were hospital/doctors visits, right there is a very good documentation of abuse for courts.
And if there were pictures taken, even so much better.
The best thing would be to go to Legal Aid and ask a lawyer how to proceed, what documents to gather.
Medical doctor too, to ask if such abuse (hitting on the ears) could be tell years later by looking into the ears.
or take MRI or a ct scan, or whatever.

Prove what?
How many angels dance on a pinhead?
Sucks
But
im certain the courts and the D.A have more pressing concerns then a guy who may have or may not have Ben smacked across the ears by his father over 30 years ago.
given the guys posts
its fairly clear he also has other more serious issues ben a few slaps over 30 years ago that came across his ears.

Since he wants criminal action as in prison as in life for is father for smacking his ears....
(Shakes head)
Don't hold your breath

Further.
having 30 year old memories of siblings who may have or may not have witness an ear slap 30 years prior
any lawyer worth his salt would have a field day with your claimed proof.
memories dint proof squat
ear slaps or know
as an aside.i was struck across a head with a crowbar when i was 22.
For a while some minutes i after i regained consciousness i thought things guys the malaise i could here again.
im certain.
perhaps this is a discovery and proof that striking people across the back of the heads cures Deafness.
mmmmm...
Keep it a secret.
Lest it steals any fire from the CI cult....or gives em any other ideas...

that's fine and dandy, but if a client - even Ben- goes into a lawyer office and ask to take his case,
the lawyer decides if he will take it or not basing his response on actual professional education,
not on what you ascertain :)

What case?
I've spent a fair while in courts.
to which case are you referring?
A defence laywer is hired to defend.
Until charges are even laid. Until an investigation even warrants any....
good luck walking into a laywers office and having him or her waste their time and even listening to the sob tale.
this may suck
but that's the system.

If he's seeking criminal prosecution he needs to meet with the local prosecutor (solicitor in some states). If it's a civil suit he needs to hire a lawyer who specializes in that kind of case. Sometimes they work on contingency.

In either case, the lawyers will let him know if he has a case worth pursuing.

That's what the -any- first- lawyer will tell him - what kind of representation Ben will need, if any.
