WATSONVILLE, CA (KPIX/POONAM SANDHU/CNN) - A California landlord rented out her back master bedroom through online service Airbnb, and now the renters refuse to leave or pay.









"It's essentially like watching burglars in your house, constantly waiting for them to pick up the next item," Poonam Sandhu said.

Sandhu installed several surveillance cameras during what's become a three-week standoff.

She hired a lawyer and the cameras rolled when she served the couple eviction papers, which had no effect.

It's a lengthy process, and in the meantime the couple is holed up in the room and now living rent free.

"You can't just put somebody on the street, a hundred years ago maybe you could call Jack the leg breaker and he would take care of it for you, but you can't do that anymore," said Leo Siegal, real estate attorney. "Tenants and boarders have rights. And you have to respect those due process rights or else you risk yourself being sued."

Siegal said the couple has three previous eviction judgments against them in Santa Cruz County, and are possibly choosing this as a lifestyle.

"So they get to game the system by pro-rating their living expenses over however many months they get to live in someone's property without paying them," Siegal said.

To make matters worse, the home mysteriously developed a sewage problem during their stay that was so bad, plumbers had to shut off the water.

Sandhu had to move in with friends and offered to pay the couple for a motel, but they refused.

She said her biggest mistakes were not getting better background checks and allowing the couple to pay cash off the Airbnb platform after the first payments.

She said Airbnb has not been able to help and that should be a warning to others.


"Whenever an Airbnb transaction ends, it doesn't mean that the person is actually going to leave. And in this state, it doesn't mean that they have to leave. They have rights as a tenant," Sandhu said.

The couple is still living in the house. Sandhu is offering to pay them $1,750 just to move out. She said it goes against her principles, but she said she just wants her house back.

Sandhu's attorney has been trying to broker a deal with the couple.

Airbnb said the renters were not part of an official Airbnb reservation because once it went to cash payments, the company was no longer responsible.

The company said it protects its hosts with a $1 million guarantee when bookings are done properly.

I had heard of squatters moving in a person house while they're gone and the squatters put in new locks and put it really hard to get rid of the people b/c they have rights . I think this is so wrong !
 
What is wrong with some people?

My guess is they want a free ride....makes anybody think twice before renting out a room in their homes...I know I wouldn't do it...It happened to me before, many years ago...was a very nasty situation.

It's special because it shines a light on the whole thing otherwise known as Airbnb and how people can 'game the system' to get away with what these people are doing. No I doubt they are the only ones but guessing this homeowner wants to shed light on the nasty practice.

I don't think the police will be able to do much because as noted.. these yahoos now have 'rights' as tenants. As far as I can tell I suspect these people also know NOT to go and threaten the home owner to avoid interactions with the police. These two yahoos seem to know what to do... get in through Airbnb, switch to cash payment to avoid any kind of liability but still be able to be 'protected' under the law.

There ought to be a Top 10 list of bad Airbnb people who will nickel, dime and screw potential renters.
 
If a sexual assault occures or even a threat Of one. The police will be able to do something. The owner can file a restraining order, even if charges arent laid or pursued. Its easier then you think.
Anyway.
It doesnt mstter if it happened or not. As long as your witness backs you.
In other words. How bad do you want your house back?
Act accordingly.

Why are you calling the crininals yahoos in this? Because they know more how plsy the system to get what they want?
if they are yahoos then the person who rented to them is a damn moron deserving what she/he got.

As for making this thread...I felt it was in good faith...many people don't think twice about renting out a room in their home....without a background check...even then, some people still refuse to pay or move out when their time is up....

There's been many instances in my City and other cities as well, of "squatters" living in homes of Soldiers away on duty...people on vacation....list goes on and on...and having a hell of a time getting them out of there...

No one should have to file a false report to get people out of their homes!

Im saying if someone takes your house. Then you should be willing to get dirty to get it back.
File the report.
Its not false. stick by it. Bruises r easy to MAke. Choose your witness wisely..

When I rented an apt with my friends, the apt was in my name because I was the only one with good credit. Well, after a year, my friends and I were just not getting along anymore so I told them to move out. They refused and I went to court. Learned that they had rights to live there even though their names weren't on the lease. The courts said I could file complaints against them but it would take time and money. I just "kicked" myself out of the apt and moved to a different apt. I cant imagine this situation because that situation I experienced was very very stressful and disruptive.

either you pay so you can live somewhere or you do not pay in which case you get evicted for "not paying". you get a warning period of -I don't know how many weeks - to come up with a payment and if still not paid, it's :wave: bye bye :wave:

I don't get it either....had the same problem years ago, even called the Police...they said or asked me if the roommate paid any rent...and I said yes, but was not on the Lease...Too bad!...Would have to go to Court and serve eviction proceedings...and a lot of other things I would have to do...Never again!...Learned a good lesson the hard way...just never know if they will destroy ur home or bring in drugs.

So many good reasons to have a large dog who can be many things on demand :D never had to worry about this.

They do have the right to evict but the process takes a long time. Sadly, the people who do this know all the in's and out's and become professional squatters.
 
I remember watching a reality show about property management and there were professional squatters who had managed to stay rent-free for over 6 months. And they were only able to kick them out because one of them was cooking moonshine, which violates fire safety codes.

Unbelievable I know but that's what they had to do just to kick them out.
 
I am a little at a loss...what rights do the tennets have that would protect them when they are not paying their contracted rent?....or is it that a contract was not drawn that clearly outlines that they must leave if they do not pay?...

the rights vary state laws.
