I don't think he makes that decision and he probably is contracted by the state to take the body. My guess is, he is just working on behalf of the family. This can't exactly be handled like a John Doe situation.

I'm sure there are other terrorist who will pay to have the body brought to Russia.

This will work itself out. The government will step in at some point.

Right. If he was a John Doe or an indigent with no family his remains probably would have been cremated and sent to the local potter's field (or whatever is equivalent in that area). But since the family has claimed responsibility for the body, they're pretty much stuck. I don't think the government has any say in the matter.
 
Should throw him off a boat like Osama bin Laden. Never bury any terrorists on US soil!
Legally speaking, Tsarnaev died a suspect, not a convicted terrorist.

yup. I certainly hope we treat his body with respect. we are not uncivilized animal like these Chechnya terrorists.

the only way to stop terrorism is to treat the captures/dead with respect. nobody said it's easy but it's too easy to hate.

The funeral home has asked the governor of Boston to help but the governor was on TV tonight and he said this is not a state or federal issue , it up the family . Government is not getting involved with it.
There is a group of people trying to raise money to have the body send back to Russia , that will cost about $7,000 .

Agree. If burying his body on US soil, someone can damage or painted his tombstone. Better be it off

(a) Offense Against a National of the United States or Within the United States.— A person who, without lawful authority, uses, threatens, or attempts or conspires to use, a weapon of mass destruction— (1) against a national of the United States while such national is outside of the United States;
(2) against any person or property within the United States, and (A) the mail or any facility of interstate or foreign commerce is used in furtherance of the offense;
(B) such property is used in interstate or foreign commerce or in an activity that affects interstate or foreign commerce;
(C) any perpetrator travels in or causes another to travel in interstate or foreign commerce in furtherance of the offense; or
(D) the offense, or the results of the offense, affect interstate or foreign commerce, or, in the case of a threat, attempt, or conspiracy, would have affected interstate or foreign commerce;

(3) against any property that is owned, leased or used by the United States or by any department or agency of the United States, whether the property is within or outside of the United States; or
(4) against any property within the United States that is owned, leased, or used by a foreign government,
shall be imprisoned for any term of years or for life, and if death results, shall be punished by death or imprisoned for any term of years or for life.

so how about LA Bank Robbers or Dorner? they're just "robbers" and "shooters" while Tsarnaev Brothers are terrorists simply because they used bombs instead of guns?

It really looks like no cemetery in Massachusetts what to take the body, I wonder if they're worried people will not want to buried their family member where Tasrnaev's body is buried.

A lot of cemeteries now don't even allow tombstones. They use flat bronze markers instead. It makes upkeep of the grounds easier and cheaper. Engraving names on them is not required. Cemeteries keep track of who's buried where by grid charts.

He wasn't a citizen of the U.S., so he has no right to be buried here. His organization is trying to raise up to $5,000 to have his body shipped overseas.
