Man Gets Life in Prison for Spitting

SAPULPA, Okla. - A convicted rapist has been sentenced to life in prison for spitting on a police officer.



Creek County Associate District Judge April Sellers White followed the recommendation of a jury for the maximum sentence against John C. Marquez under a law that makes it a felony to place bodily fluids on law enforcement officers.


White rejected a prosecution request for a 25-year prison term and a defense request for a four-year term.


Following sentencing Monday, Marquez's attorney, Jason Serner, promised an appeal to the state Court of Criminal Appeals. No appeal had been filed by Thursday.


Marquez, 35, was convicted of hurling body fluids on Sapulpa Officer Charles Gadd while Gadd was taking Marquez to jail following a domestic disturbance in which a woman's arm was broken.


The 1996 state law that makes it a felony to place bodily fluids on law enforcement officers was enacted amid concerns that deadly diseases, such as AIDS (news - web sites), could be transmitted this way.


Gadd told the jury that Marquez spit on him despite being warned and then bit him when Gadd was trying to prevent Marquez from spitting again.


Gadd and Marquez tested negative for any communicable diseases.


The jury took 15 minutes on May 14 to recommend the life sentence. Marquez's prior felony convictions, including rape and burglary, were taken into consideration in determining the sentence.


In addition to the life term, Marquez received one year in jail and a $3,000 fine for his conviction for domestic assault and a $500 fine for resisting a peace officer.


Telephone calls to the judge, the prosecuting attorney and the defense attorney were not returned Thursday.
 
sound tooo extermely to me. i see the police still alive. "Why life sentence for him to receive while the police still alive. " yes spilt is bad manner to do. some ppl have bad manners but not receive life sentence. hmmm

he has prior felony convictions for rape and burglary -- i say WTG Oklahoma jury!!!!!

the defendant brought it upon himself and with his prior felony convictions -- i dont see how this is "extreme"
 
The law in New Jersey works that way too, if you commit THREE offences, then you can be sent to jail for life. I agree, this might seem extreme.
 
HUH for spitting that is dumb for life HUH why not give him fine or jail but not stay in jail forever that dumb thing i even hear !

ohh i didnt know that NJ has that law as well -- i knew CA does

PRIOR OFFENSES??? hes a gonner h e should have thought twice i dont care how extreme it is he * assulted* a officer with bodily fluid that can contract AIDS that can be charged as a murder charge if he did have aids and the officer ended up with aids, therefore he deserved what he got!
 
Yes, I think it's a bit dumb. But, in a way, it's good. With all of the diseases that's going around these days, you can't be careful. Yes, the policeman is alright, but think about it this way... I open fire at a policeman and missed. Did I hurt the policeman? Did I kill him? No, I didn't. However, I could have. Therefore, I'd be tried for attempted murder.

I think I missed the point -- who's Nelson? :P Sorry...just had to get this cleared so I can understand why it's so funny about Nelson.

BTW, I think the policing laws have been overdone...overkill. But hey, it's not me who's making the laws. :shock:

Nelson is a bully, who likes to bully and hurt people... You would proably know him in the infamous TV show "the simpsons"...

Supposedly, the man never had any criminal offences.

But he decided to spit onto a cop three times and convicted three times for the crime... is that necessary for him to get a life sentence?

I don't think so.
 
You see the Oklahoma Law made a stupid thing over here. For example, here in oklahoma if you touch as get attention or anything such as shake a little. Automatic you face fine for battery. I think that silly.

You've got to be joking! *smh* I've been hearing a lot of silly laws/rules in each state in the USA...even in other countries as well. I just don't get it why they create such silly rules for simple and seemingly harmless stuff. I can't think of anything at the moment, but I just KNOW there are heaps of stupid laws out there. Laws that simply just don't apply to everyday lives.
