Although I wonder... in SC and Georgia there is a line of self defense and maiming... I wonder if this would fall under the lines of maiming and result in being in legal trouble.

I know in GA and SC you can defend yourself... However, there is a maiming clause that can bite the victim in the rear. The example that was given to me was if someone took out both eyes of an attacker, they could be hit for maiming because you made the blind. Yet, one eye was not and you are in the clear.
So... it begs the odd question... does this constitute as maiming?
 
Maybe it is where I am from that has jaded my view... but so many of the woman's self defense courses or those rape prevention things are ridiculous.... proper training is advisable...yet, men and women can take classes and will still freeze up when faced with a fight or flight situation.. more so in a life or death one.... or find that their training does not equate to a hill of beans...especially against an armed thug...

I think it would be better to be in legal trouble and alive rather than not and be dead!

I've been searching and I can't find any SC laws against maiming except for animals.

Apparently self defense is self defense, using whatever mode is necessary. If that mode results in maiming or death, so be it, too bad.

I have shot an email off to the lawyer that confirmed what I was told a while back and will post his response when I get it.
I have always thought it was funny that we have free right to shoot someone dead for threatening our lives or those around us but there is stipulations about how much harm one can do.

Yes, I would be interested in knowing what section of the SC Code that would come under.
 
From what I've read *or been told*...example is:...if someone is trying to break into ur House...and you shoot that person while he/she is outside, then you can be charged...But if that person is already inside your home, you have the right to shoot, even maim...
I could care less the boy was 16 and got his tongue bit off...Actually, his dick would have been a better spot...as he was trying to rape this woman, on top of her...horrifying experience, no doubt...and most times, Rapists don't leave a witness.

But as I told Reba, this is just something I was told, and am currently seeing if the teacher and lawyer that said it can find a case or law that it originates from. Sorry, I should of reread the post. It was your post that talked about the maiming clause and the possibility that you could be in legal trouble if you maimed your attacker. I thought my statement was rather clear as to state " that you would be better off to have legal trouble than be dead from the attack. From the law enforcement people I have known they have said if you are in fear of your life, you are in the clear legally, so hopefully the same would be in effect in GA and SC, but who knows?
 
Yes, but at least put a disclaimer in saying that they are 6 months, one year, two years or however old they are. Don't pass them off as current news.
