2:41 p.m. update: There were three of the victims’ family members and one friend who observed the execution. All of them were wearing t-shirts with the three brothers’ photos on them.
2:21 p.m. update: When asked if he had any final words, Brooks said “No.” Once the warden gave the go-ahead to inject him, Brooks stuck out his middle finger. Those who witnessed the execution gasped. As he slowly went to sleep, his middle finger stayed sticking up.
2:07 p.m. update: Reginald Brooks’ execution was carried out. His time of death was 2:04 p.m.
1:29 p.m. update: All of the witnesses have been called to go to the observation room.
12:11 p.m. update: The execution has been pushed back again, this time to 1:30 p.m.
11:25 a.m. update: The Supreme Court has denied all last minute appeals from Reginald Brooks. He is now set to die by lethal injection at 12:20 p.m.
10:43 a.m. update: The U.S. Supreme Court ruled against Brooks' appeal, but there is still another appeal that has been filed based on a Nov. 4 ruling. That ruling from the U.S. District Court of Northern Ohio was against Brooks, but it was never entered into the docket. Essentially, Brooks’ case will go back to the U.S. Supreme Court again. While this sounds like a lengthy legal process, Brooks could still be executed early Tuesday.
9:45 a.m. update: Ohio prison officials are temporarily delaying the execution Reginald Brooks until federal courts issue their final rulings. Brooks has appeals pending before a federal appeals court in Cincinnati and the U.S. Supreme Court. The 66-year-old was scheduled to die by injection at 10 a.m. Department of Rehabilitation and Correction spokesman Carlo LoParo says officials must wait for the pending legal issues to be resolved before they proceed with the execution.
9:30 a.m. update: The steel lobby door to the Southern Ohio Correctional Facility marked "employees and visitors" was heavy and cold. Inside, a cheerful woman behind a long wooden desk told me to empty my pockets, take off my belt, and remove my suit coat. The metal detector went off anyway, so I removed my shoes. I was officially inside the brick, concrete and steel walls of Lucasville Prison -- population 1,438.
The guard took my station ID and drivers license but let me keep my cell phone. The screen read 7:30 a.m.

That, plus he was smart enough to buy a bus ticket and pack a bag with vital documents to start a new life. No doubt he knew right from wrong. And obviously the Judges believed that as well or they would have stopped the execution..

I'm sorry, Babyblue, but you are very incorrect in your statement that mental illness is mental illness. There is a great deal of difference in the disorders that can be classified as mental illness. You cannot compare a psychotic illness to a personality disorder in the impact that it has on the individual.
And again, Andrea Yates knew in advance that she was going to kill her children. Yet you excuse her actions due to her psychosis. Brooks suffered the same type of psychosis. Maybe even to a greater degree.

a person with schizophrenia can function like a normal person and it's just a matter of time till he gets a psychotic breakout or delusional episode.
He was fine when planning and delusional while killing.... is what you are saying. I doubt that. He knew what he was doing the whole time.
People have no understanding of the insanity defense. And this is not about the insanity defense to begin with. It is about evidence of his mental state that would have prevented him being sentenced to death that was withheld. It is about that evidence coming to light, and the Governor of the state of Ohio refusing to commute the sentence in light of that evidence. The man was mentally ill when he was executed.
The U.S. Supreme Court agrees.

If I had decided to rape you, then started raping your children in front of you and got out a huge blade and cut your child's head off very slowly while you listen to your child screaming as he or she is dying. Just because you're mentally against it doesn't mean you won't change your mind when I do crap to you and your family right in front of you, the second that happens, you'll want me dead immediately.

If you have a mental retardation (meaning - you have a mind of 10 years old or something) and you murdered my family right in front of me, well I'm bound by my moral sense and my strong belief in Constitution that you should not be executed. It's illegal to execute one with mental retardation so how would that make me feel better? That would make me a murderer too and any normal, sane person with conscience cannot live with that.
I'm sorry that you are incapable of understanding a higher moral standard. If you prefer to believe in what you just told me, then you should have no problem living in Middle East or any third world country. Sounds like you have no problem with chopping off thieves' hands which is a common punishment in those countries or stoning women for their infidelity or shaming your family.
