Could he have taken the hat back and walked away?

Well....suppose I go up to you and say..."haha,,,,ur wearing the rainbow colors!"...and snatch ur hat and walk off....that's OK with you? Ur supposed to let me insult you, then take ur hat, and let me walk away?...Almost all men and boys are protective of their hats!...and if ur a straight guy, would you let me insult you and call you "gay"??....I've seen adult guys getting into fights when somebody snatches their hat for the fun of it!

The other boy was a big bully! Much bigger than my son, and had several of his friends around him! Plus the fact, they were in the cafeteria eating. Why should my son have to get up and leave? He was eating....And the other kid threw the first punch, chipped my son's tooth and he also had a swollen jaw!...And you say that he should have just got his hat back and walked off?....Nah!...The other kid got what he deserved! Enuf said!

I was simply wondering if it was possible if your son could have walked away after retrieving his hat. I wasn't saying what he did do was good or bad.

Not sure of that....the other boy's parents, as far as I know, have not been to the school to talk with the Principal. And the Princial did not offer any information on the boy's parents. All I'm going to do at this point, is pay the bill myself, keep the bill for future reference in case the other boy's parents decide to pursue this, perhaps with their own son's dental/medical bills.
If my son would have lost his tooth, it would be a different story! Calling my lawyer would have been one of the 1st things I would do. So I figure it's a "waiting game" to see what the other parent's are going to do, if anything.....Hopefully, nothing...so we can get this behind us and move on. There are always many fights when school is almost out for the summer, and here in Florida, it's in June, only a few weeks left.

The bully escalated the fight. I'd say he was in the right to protect himself after getting punched first. Security guard wasn't around. Neither were adults at the time according to what RR said. He wasn't there to cause a fight in the first place. The bully was looking for a fight. Nuff said. Else he would've ended up in suspension for 5 days. The bully is doing that now. What's sad was what the bully tried to do, not the other way around.

My family always taught their children, don't get physical and don't speak back unless you're being whaled upon. Why? Most people out there are looking for a conflicts that get escalated from trying to set a boundary. If it's serious enough enough that you have to stand up for yourself, that's why you use the legal system.

It's the same thing they taught for over a century now.

You're not the parent here. There is a time and place to stand up for oneself rather than to allow yourself get beat up senselessly. Hence, it's called "self- defense" when you fight back to protect yourself.

And I got detentions a few times for "defending myself." The school administration made the right decisions, in hind-sight. Not every battle is worth fighting.

Better to fight back in self defense than become easy picking for a bully.

That was when I saw (around age 20 or 21) that the school administration did a good thing by disciplining their students into taking the legal recourse, instead of enabling people to "stand up for themselves."

So... yeah, not every battle worth fighting, and the ones that are... are better hashed out in civil courts.

yep. same applies for CCW holder. just cuz you have a gun doesn't mean you can always defend yourself with gun. Both of you will be screwed by the law.

Rule #1 in CCW and all martial arts - Avoid the conflict. If you cannot - assess the situation. Take appropriate action as needed.

Yeah, most of us is understanding that time and place. The question is not was his son in the wrong for defending himself. It was more, was the other kid picking on his son the whole time, and the hat part was the last straw? Since we where told the other boy been in more trouble then just this, is he a class bully? What other factors where in play here?

If my sons where in the same boat and his, I would hope my boys would have done the same thing in return. It is a time and place to pick a fight, but you always have the right to defend yourself, in words or fists. 1st things 1st, try to solve the problem in words, and if the other party gets tired of that and throws the 1st punch, then let all hell break lose. Just one thing I will make sure I kids do know, if they have to do self-defense, they know to only defend themselves till the threat is no more.

This is key...you have to know the right time for all things.
