She will still be arrested for having sex with a minor after finding out who is the father of the baby.
 
she proabably didn't want to give it up to adoption as it could come back and haunt her. As long as the baby is alive, they could do a genetic testing to prove that she did in fact had sex with an 16 years old. I don't see the point of killing the baby as the punishment for murdering is worst, especially they know she already gave birth.

she should have used birth control.
