Memphis Teen Shot in Behind Over Sagging Pants

exactly, then spell it out like a grown man.

shel, it was in buttocks...maybe they'll consider differently if shot in back or chest? I wonder.

If that happened and the boy was in critical condition - they may upgrade it to Class B or even A which is even a much longer jail sentence. Right now - I believe his Aggravated Assault is Class C Felony but we'll see.

Assault and Aggravated Assault Defined

39-13-101. Assault. 39-13-102. Aggravated Assault.

Tennessee law provides that a person who commits assault must have done one of the following:

Intentionally, knowingly, or recklessly caused bodily injury to another;
Intentionally or knowingly caused another to reasonably fear imminent bodily injury; or Intentionally or knowingly caused physical contact with another and a reasonable person would regard the contact as extremely offensive or provocative.

Aggravated assault requires the use of a deadly weapon or serious bodily injury to have occurred. Tennessee law provides that a person commits aggravated assault who intentionally, knowingly, or recklessly commits an assault as defined above and:

Causes serious bodily injury to another; or
Uses or displays a deadly weapon

Mind you - I'm going by Tennessee's criminal codes. From what I see - its criminal homicide code has 7 categories:

1. First Degree Murder
2. Second Degree Murder
3. Voluntary Manslaughter
4. Reckless Homicide
5. Criminally-Negligent Homicide
6. Assisted Suicide
7. Vehicular Homicide

If the boy died from gunshot.... this man would most likely be charged with Voluntary Manslaughter.

Wow! So now people shoot others over the way they dress. :hmm:

This is nothing new. It has been happening since the 1990s when the blood and crips gang war escalated to a national level. A black man wearing blue would shoot another black man just because he was wearing red and vice versa.

As for sagging pants, I can't stand them and I'm 26. I usually don't say anything unless I am seeing things that are only meant to be seen in the bedroom.

1990's? It has been since 1960's.

Eh? In 1850 New York City recorded more than 200 gang wars fought largely by youth gangs.

What was the motive behind the 1850 gang wars of New York?

I would guess ethnic status and racial status between Europeans and Blacks.

Ex: English against the Irish
Italians against the Germans
Whites against freed Blacks.

But here it is more about the way one dresses rather than ethnic, racial, or economic status or even ideas such as the war between Protestants and Catholics in Northern Ireland.

To the bolded, are you sure about that? I think the gang wars in 1850 was a result of wretched living conditions. It was proven that if you overcrowd rats, they turn violent and cannibalistic (though I am not comparing gangs to rats, mind you). Who cares what the motives for gangs are if you know the cause? Those wearing these low pants are predominantly black (and I have contempt for well-to-do whites who copy the style) and are from economically depressed areas, and this is their way of stating who they are and how they feel about it. There have been countless gangs throughout all stages of history, and in the end, one realizes it is because of lack of money and their standing in society, IMO.

that's what Aggravated Assault (also Assault With Deadly Weapon) is for.

Attempted Murder is the "failed premeditated murder"

It doesn't have to be premeditated to end up as attempted. The vast majority of murders do not meet the criteria for premeditation. They are decided at the spur of the moment as a reaction to a specific circumstance. A failed murder, in this case, would also lead to charges of attempted murder. Attempted murder is a charge based on intent at the time of the action, not premeditaion alone.
