Jerry Sandusky Will get His Pension!!

They can wave those pension checks in Jerry's face. Not much he can do with them. If he needed some quick cash, he could write a "If I Did This" book.

Hold all comments until we find out the law.....Can a criminal profit from his crime?

In otherword, Jerry might not be able to write a "tell-it-all" book and profit from this book.

I believe that's the "Son of Sam Law."

I believe that's the "Son of Sam Law."

And you would be correct. My point would be that there might be ways around this law. Suppose the real story is told through his wife. Is the profit hers although she is really a "ghost writer" for him? Very complex issue. And I'm not a lawyer.

I'm not quite sure what you mean by "cannot benefit from this pension." He probably can't spend it in prison other than what's allowed in the prison canteen but that doesn't mean his family can't use it.

Whether or not his wife committed a crime is irrelevant to her access to his pension. If he allows her as a joint signer to his pension account, then there's no problem for her.
As well they should have access. They are also victims in this. I am not going to assume the family knew this was going on. If there comes some indictments towards his wife and other family members, I would feel differently. Until then, let them enjoy the pension. Not much Jerry can buy in prison, and his sentence will likely end the first time he is released into the general prison population.

His children are all adults so I guess they don't get any of the pension money.

That would be up to Jerry and his wife. They are not young, and I would suspect they did some will planning during the last 6 months. I guess we hope for something good to come of it.

Must be nice to be the wife and entitled to those pension money, but it will come back to bite them.

Say the victim wanted to sue Sandusky, then they would come after the pension. Then wife will have to spend money defending her husband.

It depends on the pension plan. Some of them don't continue after death, or they continue but at a lower amount and with other restrictions.

That's right. It's called survivor's benefit. So that means if I receive the retirement money with survivor's benefit, my spouse will receive my retirement money (probably about 75%) after I die.

Estimate:

retirement w/ survivor's benefit-------retirement w/o survivor's benefit

I will get
$2,000 per month--------------------$2,200 per month

Anyway some people still work at USPS for more than 40 years. One of them finally retired but died next month. His retirement fund was gone because his wife passed away a long time ago and his kids are adults. Imagine how much his retirement fund was deducted from paychecks for more than 40 years. What a waste. Everybody at work talked about it.

Sad. :( That's the gamble one takes with retirement pension plans.
