Former cop sues Kentucky hunting store after accidentally shooting off his own finger

IMO, the gun shop is at fault because what they sell should be unloaded for safety purpose.

of course the gun shop is at fault. a person got injured on its property and an employee failed to check their guns.

you don't own a gun so you wouldn't understand. legally - it's the store's fault to check the gun. but it's a common knowledge for decades that you are responsible for every bullet that comes out of a gun you're holding.

it's called a safe gun handling. the cop failed to do that.

I never owned a gun and the first thing that cross my mind was this is a cop
he should had checked the gun or asked if was loaded .

yea it should be his second nature but looks like he wasn't a good cop. more like a lazy incompetent officer.

I know you need to check your gun b/c my dad forgot to check his and end up killing our hot water heater ! My mom said she heard water running in the basement , it was flooded ! Our kitchen floor had a bullet hole in it the size of a quarter . Dad said to always keep your gun aimed away from people and toward the floor , it was good thing the gun was not pointing at his feet.

Alright, the ex-cop didn't check to make sure there were no bullets before testing it. It's still not the idiot's fault so he has rights to sue the gun shop who gave him the loaded gun, doesn't he?

Anyway (off topic), black market gun dealers would not let it happen because once they give a buyer a loaded gun to test, the buyer could have shot the dealer and get away with it.

everybody has a boss. that buyer would be hunted down by the boss.

if not.... that buyer would be hunted down by cops. why risk that?

and why would they be able to test-fire a gun? if it's being down in some remote area... why not a gun dealer robs him?

How? They sell guns in the alley or someplace like that with no video surveillance.

Its called "Suicide", cause doing so, never know if your caught alive and be subject to brutal torture by these nasty bosses. In black market, never I mean never ever **** somebody in there, cause they don't care about money, they care about blood.

Yes, the cop customer should have been more careful but legally, the shop is at fault. They shouldn't be putting loaded guns out on display or handing a loaded gun to a customer outside of the shooting range.

It seems unlikely that the shop would accept a loaded gun as a trade-in or sale. The shop personnel usually examine a gun fully before making an offer. They need to know its condition before placing a value on it.

It's possible that it was taken to the range for a "test ride," and then returned to the case without checking it, maybe during a busy period. Still, a wrong action by the shop.

Even though the cop should know better, the ultimate responsibility is always on the shop personnel. The person behind the counter should never assume the customer knows the proper way to check or handle a weapon. In that sense, they should treat each customer like a gun newbie.

The person behind the counter was lucky he did not get shot in the guts !
I wonder if the case with come out 50/50 at fault b/c the guy was a cop ?
 
Hard to see the details on the video but it appears to me that the gun goes off after the cop pulled back the slide. It also appears that the clerk did NOT check the gun before handing it to the cop.

The position he was holding the gun, he's lucky the shot didn't hit the customer standing to his side, or anyone else in the shop. There were several other people there!
