Deaf man filed a lawsuit against Wendy's

Personally, I don't believe this person is entitled to any money. He should instead push for them to install a special machine.

Oh Dear Defee !! I am afraid the fast food sever would sue me. My pronouce would sound like a monkey. They may freak and call the Zoo to catch me as wrong one.

I may scare them away !! They may send me bunches of bananas instead of cheeseburger, fried french and milk shaker. ;)

I can say "Fuck YOU" on the speaker box. I may go to the jail with bbnt. :D

WESTBOROUGH, Mass. -- A deaf man filed a federal lawsuit against Wendy's Friday after he was allegedly refused service at the fast-food restaurant's drive-through in Westborough, Mass.

Janet Wu Reports On Lawsuit

NewsCenter 5's Janet Wu reported that Howard Kaplan said that it was three years ago when the manager allegedly threatened to call police after he tried to talk to the employee using sign language.

Same man that been incident in 3 years ago? I believe he may have no patient.

Kaplan said that he passed the microphone area and proceeded the second window because he found no one at the first window. He indicated to the cashier that he needed a paper and pencil to write down his order. She took the paper, punched his order in and then called the manager over to the window.
It's better to have own paper and pen or use sidekick to write up. For some reason, rare happen don't have available.

"It was at this point that the manager told him that he needed to go back around to the microphone again. This is when the altercation ensued. She yelled at him. He didn't understand what she was saying. He tried to tell her he wanted his food, but she refused. She continued to yell at him," Kaplan's attorney Rebecca Pontikes said.

"The manager did not yell at him, and in fact, it was just the opposite. I talked to all the employees on duty at that time myself," co-owner William Zanke said in a telephone interview.
the manager thought deaf required to yell to make the deaf person to hear it. How dumb she is. That mean, she must be blonde.

"Calling it a miscommunication sidesteps the entire issue. There is a problem here because a deaf person could not use the Wendy's drive-through in the same way that a hearing person can," Pontikes said.
There is always a miscommunication bettween hearing impaired, hard of hearing and hearing.

geez what a snob fast-food service they all are :rolls:

I heard in Arizona they have drive thru for deaf people to push buttons what they want.. wish they have those all over America..

I do too! It would be nice to have the menu that had buttons instead of talking thru the speakers. Wish it be a new technology for fast food restaurants... Cause I don't want to want my baby up from his nap, and I just want to order Biggie Diet Coke and Bigges fries and then go instead of getting my baby out from the car seat and walk to there and carry the pop and fries and go.

I remember going through a drive-thru somewhere in Atlanta's east suburbs where the deaf could easily order foods on the touch pad. I do not know if is widespread all over in Atlanta and immediate suburbs.

The only disadvantage I can think about such for the deaf is that you cannot tell them what you want or don't want on your foods!

Going inside the restaurants are a lot better for the general population. Don't go there if you don't have the time to go inside and get your foods. :)

Your right, so if you know your going to a drive through try and be prepaired to handle them, its helpful to have a piece of paper with what you want writen down, that way there is alot less confusion. Just so you know, they are usualy fairly rude to us hearing people too, its not just to deaf people, and honestly if i was paid what they were for what they do i wouldn't care about the customer either.

yeah, I always write down on paper what i would like to order.. and drive by.. (depends on face to face or speaker to.. )..
I dont have any problems with it around here north st paul and maplewood.. they are very totally understand.. that i drove up and told them, signed like.. "cant hear" and give paper to them.. they took the order and told me the total.. thats it. ! :)

How dumb she is. That mean, she must be blonde.

Or maybe she has black , red , brownish hair....

Personally I don't think she was ' dumb ' maybe she hasn't been around with deaf people before :o .....We all learn one day or the other...IMO

Wendy, I agree with you that they should have those touch screens with options and menu at the drive thrus everywhere. Maybe if enough people make a demand for that...? After all, the customer is always right!

It definitely can be hard to tell who is telling the truth and who is not telling the truth. Not totally foolproof. Once again, there's the default philosophy in such businesses: the customer is always right. lol the avenue of technology will definitely make things more convenient for everyone, so why don't the businesses just take advantage of that?

:werd: or hm use small tty that a person willing to answer tty if a deafie ask for help at the window eh? i don't know else but eh.. I wish techology wud get better soon.. so :)
