Looked into the gmail privacy bit years ago. Basically some higher ups in the corp will be able to have access to read the emails in your account, should they feel the need to. Think realistically, no one will be browsing your account in millions of email accounts unless you're related to the person somehow, or are Osama bin laden (even then google might side with him since they're fierce on user privacy in courts).
The EULA states somewhere that all your content is owned solely by them. You agree to it when you click the sign up button. The advertisements are automatically generated based on the email contents using key words, presumably from their adsense technology.
It's the same thing with most major free email providers. Even yahoo.
