Littering in Tennessee is no laughing matter and has serious legal consequences, but should you go to court for tossing something as small as a cigarette butt out the window?

One Antioch woman missed three days of work and spent hundreds of dollars on legal help trying to keep herself out of jail because she said the officer wrote down the wrong code violation.

Heidi Bowers, 33, was running an errand for work on Aug. 24. She drove her husband’s car that day, which doesn’t have an ashtray.

She was driving down Murfreesboro Road when she tossed out her cigarette butt.

In a panic moment, my cigarette was running down, and I’m like, ‘There’s no ashtray in this car. What am I doing?’” said Bowers. “I ended up tossing it out the window. I absolutely admit I was wrong. Lo and behold the lights started spinning behind me.”

The wife and mother said she hadn’t been pulled over in years, so she thought what happened next might be new procedure.

“He asked me to step out of the car, which at that point was very weird,” explained Bowers. “He asked me to put my fingerprint on this little scanner he had. Then he asked me to back up and take my picture.

“The whole time I was thinking ‘this is new,’ but I haven’t been pulled over in a while, I’ll go with it.

“Then he said ‘Today you’ve been arrested for littering. Criminal littering.’”

The officer told her to go to the courthouse and report for booking “or you will go to jail,” she said. “And I thought my smile’s gone. What’s going on here?”

When Bowers got home, she researched Tennessee littering laws, which revealed the officer must have made a mistake.

“It’s [TCA] 39-13-503, a minor class C,” said Bowers. “You send in $50 to the county clerk and go on with your life. He wrote me up for a 504, which is criminal misdemeanor littering.”

Tennessee Code Annotated 39-13-504 defines criminal littering as an amount more than five pounds in weight or 7.5 Cubic feet in volume.

Bowers got a lawyer who agreed that it was obviously the wrong charge and he would clear it all up.

When the two showed up for booking, that didn’t happen.

“You take your mug shot then go out to the courthouse,” said Bowers. “Meanwhile, I’m literally around people that have really committed crimes, assault, drunk driving, marijuana and I threw a cigarette butt out the window.”

Once in court, the judge wouldn’t budge. Bowers accepted four hours of community service and the charge for criminal littering would stand.

“You go through your life trying to be a good person, always, and this happens,” said Bowers. “You’re getting arrested. It’s crazy.”

Channel 4 asked Metro Police about Brewer’s case.

“It is the officer’s discretion to issued that citation. It is then up to the court to determine whether the citation should be amended,” police said in a written statement. “If there was an error on the part of the officer, he’ll be made aware.”

Bower will return to court on Nov. 23 where she will attempt to have her record expunged.

that one way of giving up smoking but criminal record a little harsh
 
Many people who do smoke...have ashtrays in their car that they bring if the car has no ashtray.....

And a Law has been passed (or considered) being passed that you cannot smoke in a car if there are people in the car under the ages of 18...which I do agree.

Seeing the millions of ciggy butts on the beach after a N'easter...WOW!....and a lot of apartment complexes have rules that you cannot throw ciggy butts outside on the lawns....even in the parking lot.

I've seen these signs too...."Keep your butts to yourself!...Don't trash our planet!"

Seems Tennessee is cracking down big time or this Cop was having a bad day!...Nothing smells worse than a full ashtray in a car!

And have seen cars that the driver tried to throw a ciggy butt out the window, and it bounced back...causing him to swerve all over the road, almost having a wreck...

And....:laugh2:...a friend thought he had thrown the ciggy butt out the window, but it had bounced back to the back seat...and after a few minutes, smoke was coming up...the backseat was on fire. Burned a big hole in the seat cover and floor board....

Ashtrays at home?...I always run water on the ciggy butts to make sure they are completely out before throwing them into the trash...A friend had a fire in one of her trash cans at home from a still lighted ciggy butt.
 
in uk I wish law come down on dog crapping boy would I make that capital offence...Why don't they just give her a broom few hours community service and nictotine replacements

Perhaps some other punishment would be wiser....ohhhhhhh....i dunnno...perhaps picking the butts of the ground...hell i was paid to do that job along the bordwalk and peir in white rock...but.
Lets not have thinking get in the way of punishing people....better yet...flog her and cho her fingers off...that oouta teach her.....!!!
 
We had a drought early in the summer and several areas caught on fire from tossed cig butts. Unfortunate. Now that the rest of the summer has been a lot wetter it's been a non-issue, but still.
 
I can understand the serious of the offense in a drought area that is threatened by wildfires.

Otherwise, fines and/or community service should be adequate punishments.

I believe the threat of jail was for not showing up at booking, not for the littering itself. At least it was just a threat and she didn't have to go to jail.
 
Yep, its law here ( littering) and many have gotten tickets for that. Dangerous to bikers ( called a cherry bomb ) can burn someone bad, even blind someone. Ive had them bomb my windshield a few time.... Im glad they get ticketed for it.
 
Many vehicles do not have ashtray to extinguish and stash the cigarettes... this is a problem when people only have a choice just to toss them out the window.

I can't believe what carton of cigarettes cost to today over $20 . :eek3



My state was trying to pass a law that made it illegal to smoke with a child in your car , I am not sure if this passed or not. Can't people request an ashtray when buying a new car?

If they're gonna smoke in the car and it has no ashtray, then bring their own. or use a soda/water bottle.
 
Yeah they could a soda can in the cup holder , most cars have one right next to the seat .

I can't stand people throwing their butts all over the driveway , it look so nasty to me.
