TALLAHASSEE, Fla. (AP) -- Children will now be able to secretly record people who rape them under a bill Gov. Rick Scott signed.

Scott signed the bill Friday, the day after a man was acquitted of raping his stepdaughter during a second trial ordered by the Florida Supreme Court because the victim's secret recordings were illegal.

Richard McDade was serving a life sentence for raping his stepdaughter from the time she was 10 until she was 16. At his first trial, a judge allowed as evidence conversations she recorded with an MP3 player hidden in her shirt.

But the Supreme Court said that was illegal and ordered a new trial.

The bill was a response to that case.

Scott also signed a bill allowing rural letter carriers to drive their routes without seat belts.

So......
Why not teach kids to get away from.the rapists or not to.be in that situation rather then stick around and play adio video with them?
 
You gotta be kidding ! How can it be illegal for a child to record the asshole raping them !!! Once against the suspect has more rights than the victim ! This made me sick that there has to a law to made this legal.

While I agree that is ideal... Would it not be harder for a kid if the adult is living with them?
I am at a loss on how the video was thrown out or considered illegal....

Seems odd to teachh s kid to allow it to hapoen and have some secret vid set up, if its known.to soon occure

Not denying that it seems odd and pointless to teach the child to allow it to happen....its not what I teach my kids and it would be wrong if I ever said I agree with that. But then again I fear what I would do if my son or daughter ever told me someone so much as touched them wrong.... I hope I never have to find out.....

Im not a fool.but if the chikd has enough sense and for knowlege they will be raped and hence a video set up, then that same child.has enough sense and.forknowlege not to BE THERE.

The new law doesn't teach children to allow themselves to be raped and record it. It was passed so that IF a child happens to record a rape, the recording will be accepted in court.

The kind of situation this law fits is usually one where the child is in the custody and under the control, physically, emotionally, materially, of the rapist. The rapist is often a relative or boyfriend of the mother, and lives in the same house. The child may feel he or she has no where to turn, or can't escape without proof for fear of being sent back as a runaway.

Some states don't allow recorded conversations as evidence in court unless all parties on the recording have given assent, or have been recorded under a warrant permitting it. This bill makes an exception in the case of child rape.
 
The stepfather was on his late 60's....and you need to understand that many rapists will threaten the child if she tells what is going on...So many girls are too scared to report it, thinking their mother would be killed or they would be killed themselves....Very manipulating....and also, some mothers refuse to believe the child if she does tell them what is going on, and in other cases, the mother can be an alcoholic or a drug addict and needing the man's financial support...many cases....Not one size fits all in other words.

True...but teaching kids to defend their self helps. It also builds self confidence and how to handle the situation.... Furthermore... Bite marks and scratches leave evidence that is hard pressed to deny...knowing how to make them bleed discourages actions a whole lot....missing body parts....ensure it does t happen. Teaching a child to defend themselves and how to handle these types of situations greatly reduces the chances of a child being manipulated into believing this. And parents that do not want to believe cannot argue the face of evidence.... And if the parent won't believe a cop sure will.

Probably because that would mean not going to the doctor's, to school, or allow them to participate in community athletics. Rapists don't look like some sleaze off the streets: they're teachers, doctors, cops, coaches, etc. It's hard to avoid them as they tend to gravitate to positions of power to have control of their victims.

The recording law isn't intended to take the place of defenses against child rape. It's only eliminating a legal loophole that allowed courts to toss recordings the victims made.
 
huh? It's illegal to record video or audio as undercover? Why can't court understand the child's fear? this victim tried to protect themselves. SMH

Thats one way..
Another way is to teach your chikdren to be swfe, hwve sitituational awarness, and to learn and know how to use the (get away) and (not be there) idea..
learning and knowing how NOTto be easy prey is halff the battle, when it comes to any predetor, man or animal
