Question about audiograms and Social Security

Something has been bothering me .... for years. When I turned 18, my mother took me to the Social Security Administration and applied for SSI for me. I was turned down, and no reason was given.

A few years went by, I applied again, and was turned down. No reason was given.

I then applied for VR, was accepted, attended a private College then transferred to Gallaudet. I explained my situation to a faculty member, that faculty member told me that I should be getting SSI benefits. every audiologist has told me the same thing, yet I keep getting turned down for SSI.

I applied again, and I was turned down, yet again. No reason was given, I appealed, started receiving benefits, then they were cut. I went before an administrative law judge - finally, was given a reason why i was turned down. BECAUSE I CAN PLAY VIDEO GAMES!!!!

I am not kidding, that was the reason I was turned down. WTF???

I have the same exact audiogram as another person who is getting full disability, so i fail to understand why I keep getting denied benefits.

What should I do? It is my understanding that SSI is retroactive from the first time applied, is this true?
 
SS and any other government programs are retroactive from the first time applied, up to a year.

But if you want to know what to do - Appeal it all the way.
 
If it were SSI then what if your resource income was too high or were you under your parents' incomes??

Secondly, you could have asked them for the denial letter as to why your case is not approved. You ll need to find out from there. Hopefully you will talk to a NICE claims representative who have time to explain it to you. Again i still think you should re apply for SSI and SSDI as long as your resource income need to be under $2,000 per month and working/income need to be under around $760 depends on where states you are in. Also if you have tons of bonds that are over 2,000 resources then you wouldn't receive a SSI. But its ok for SSDI if you were working for close to 10 yrs and depends on the factor of ages as well.

Try to apply SSI again as long as your resource needs to be under $2,000 or working/income need to under around $760.

They said that "video games?" are you kidding me? If you have papers that they told you so, then show it to the district manager at the SSA what claims representatives told you. That was out of line.

More likely, No. It depends on the situation but your situation, probably, no but who knows. some of representatives have different opinions with what rules/factors and dates you were in back.
 
How did they even know that you play video games? Was that on the questionnaire?

That is crazy. He doesn't have a mental disability. He signed up for deaf.



Anyway,sometime they turn you down because of bank account being above certain amount. (Happened to a family) And sometimes they don't see deaf as a disability until you have a second problem like learning disbility.

Agreed. Even those most qualified are generally turned down at first filing, especially if they see that you are under age 50.

I have had Ted Kennedy (the son, not the senator) and my State Governor review my case and both told the SSA to start giving me benefits.

They still won't do it.

They need to tell you why that your case isn't approved. It has to be a reason like your resource income is too high??? They have to!

no, when I appealed after having been turned down the 4th time, I had to go before an administrative law judge hired by the SSA. He asked me those questions (through an interpreter).

The judge, IMHO, is on the payroll for the SSA. He has got to have a biased opinion .... just saying.
 
Yup, appeal that then you get to go to the state supreme court... then they will have to make judgment.... THEN... you go back to the ssa administrative judge to have him follow through on that judgment that was handed down from the state supreme court.

stupid if you ask me.

That certainly is bizarre. It sounds like the judge was just looking for some excuse to justify his decision, or maybe he has a kid at home that spends too much time on games. :dunno:

Either way, that's a bogus basis for a decision.

I hope you can get things straightened out.
