State Rep. Richard Curtis, R-La Center, admitted to having sex with a man he met at an adult video store in Spokane last week, according to a police report released Tuesday afternoon.

The police report offers a damning and far different version of events from the brief account Curtis gave to The Columbian Monday, one that seems likely to threaten Curtis’ political future.

The report is filled with graphic details of an encounter that began at a porn store on a Spokane Valley strip and concluded miles away in Curtis’ room at the city’s poshest hotel.

The police report contains an account of how Curtis allegedly donned women’s clothing, red stockings and a black sequined lingerie top before engaging in a sex act at the store. He continued to wear them throughout the night under his clothing.

Spokane police have finished their investigation and referred the case to the prosecutors for possible filing of extortion charges against Cody M. Castagna.

Castagna is a 26-year-old waiter from the Spokane area who allegedly tried to blackmail Curtis for $1,000 and threatened to reveal his “gay lifestyle” to the lawmaker’s wife if he did not pay.

Curtis, 48, is married and has two daughters. The two-term legislator and retired fire department captain was in Spokane last week for a retreat with other Republican lawmakers in preparation for the 2008 Legislature.

During a brief phone interview with Columbian Editor Lou Brancaccio Monday afternoon, Curtis said he did not have sex with the man and is not gay.

According to the police report, Curtis allegedly offered to pay $1,000 to have unprotected sex with Castagna.

“I feel that, honestly, I’m being wrongly accused and that (Curtis) is using his power to take it off of him and put it on me,” Castagna told reporters during a press conference Tuesday. “He has completely changed what actually happened and turned it around for his favor.”

“He didn’t make any threats against this guy (Curtis),” added Castanga’s attorney, David Partovi. “This is an extremely a low-level situation that’s being blown out of proportion by somebody who is trying to save themselves.”

Curtis did not return calls seeking comment Tuesday. He initially told police that he did not have sex with the man but later recanted, according to the police report. He also told police that he thought he might have been given some type of drug because his memory of the evening was hazy.

After the two men apparently had sex, Castagna allegedly left the hotel room with Curtis’ wallet, the report says. Curtis agreed to give the man $200, which he left at his hotel’s desk, only to be confronted with a demand for an additional $800, the report says.

Spokane Police Detective Tim Madsen wrote in his report that Curtis wanted to keep the whole incident quiet. At one point, Madsen told Curtis that “the toothpaste was already out of the tube.”

“Curtis told me he was just trying to put the cap back on the tube,” Madsen wrote. “I told Curtis that the suspect may victimize other people in the future, and Curtis acknowledged that part of his job was to protect people in the state of Washington. … Curtis said he wished he would have just paid the additional money to the suspect because he didn’t wish the case to be prosecuted. If the incident became public, it could cost him his marriage and career.”

Madsen, in his report, said Castagna told him that Curtis wouldn’t say what he did for a living.

“I work to help people out,” Curtis reportedly said, before adding, “If I told you, I’d have to kill you.”

Castagna said Curtis told him that “his wife knew he liked men when they got married, but she was not into that, so he only did that when he was out of town,” the detective wrote in his report.

The entire incident might have never come to light if Curtis hadn’t contacted Sgt. Roy Rhine of the Washington State Patrol. Rhine, who works out of the patrol’s Southwest Washington office, is a fellow Republican who has run for the state Legislature.

According to a Madsen’s report, Curtis contacted a friend in the Washington State Patrol and wanted the agency to investigate “because the local police would talk and it would get out to the press.” The WSP referred the case back to local officials.

The police report and court filings say that Curtis met Castagna at a Hollywood Erotic Boutique store at about 12:45 a.m. Friday and later rendezvoused at Curtis’ room at the Davenport Tower Hotel at about 3:35 a.m.

As part of their investigation, Spokane police have seized video recordings from the hotel and the sex shop, computerized records of when Curtis’ hotel room door was opened and closed, and hotel records purportedly showing the rental of gay porn movies by someone in Curtis’ room.

Castagna’s Myspace.com Web page indicates that he is gay. A search for Castagna in court records turned up a number of cases in Spokane and King County on a variety of charges. Most cases were in juvenile court and involved charges of assault, theft, burglary and malicious mischief.

As an adult, court records showed that Castagna pleaded guilty in 2001 to a forgery charge and was sentenced to two months in jail and 12 months in community custody.

Partovi said he called the press conference Tuesday due to the severity of the charges being considered against his client.

“Extortion is a violent Class B felony. It starts with a serious jail sentence, and this guy (Castagna) didn’t do anything wrong — at that level, anyway,” Partovi said.

I am curious what do you think about this? I know the La Center is quite of infamous "Gambling City", but it's important to my location.

I don't really understand why would they charge and put Castagna in jail while they was unsure if their story was true? There is kinda of stuff that are suspection that Curtis DID something with Castagna while they prove that Curtis attended to the porn store and drop $200 at the hotel for Castagna. I just don't understand why the police would do such..

State Rep. Richard Curtis, whose claim of being the victim of an extortion scheme resulted in disclosure of raw details about his sexual behavior, resigned from the Legislature today.

In a statement released by the Republican caucus, Curtis, R-La Center, said "Today I submitted my letter of resignation to Gov. (Chris) Gregoire effective immediately. While I believe we've done some good and helped a lot of people during the time I served in the Legislature, events that have recently come to light have hurt a lot of people. I sincerely apologize for any pain my actions may have caused.



“This has been damaging to my family, and I don't want to subject them to any additional pain that might result from carrying out this matter under the scrutiny that comes with holding public office,” Curtis' statement said.

"I am very disappointed by the news reports of the conduct by Rep. Curtis last week in Spokane," according to a statement from House Minority Leader Richard DeBolt, R-Chehalis. "After discussing this matter with House Republican leaders, he has submitted his resignation, which we feel is best for everyone involved.

"The troubling details continue to emerge, however, (and) it has become clear that he can no longer effectively represent the constituents who elected him. We pray that Richard and his family have the strength and support they need to meet the personal challenges they face.”

A retired fire captain and two-term legislator, Curtis has been feeling the glare of the spotlight since Monday, when it was disclosed he was involved in an incident in Spokane last week with a 26-year-old man. According to a report filed by Spokane police, Curtis met the man at a porn store in the Spokane Valley, and later had sex with him in a downtown hotel room. The man, Cody Castagna, claims he was promised $1,000 for unprotected sex.
Curtis was in town attending a pre-session retreat for Republican legislators. He denied being gay or having sex with Castagna in an interview earlier this week. But a police report on the incident said Curtis had told investigators that he'd had sex with Castagna, though not unprotected and not for money. Curtis was also seen participating in a sex act with a different man at the porn shop, while Curtis was wearing women's undergarments.

KXLY-TV is reporting that Spokane City Attorney Howard Delaney said Wednesday morning that he intends to review police reports in the attempted blackmailing of Curtis to determine whether or not Curtis should face solicitation charges.

Delaney confirmed that once the Spokane County Prosecutor Steve Tucker's office has done its review of police reports detailing the blackmail case that he would look at the case to determine whether or not Curtis solicited Castagna for sex.
 
Curtis breaks public silence

Richard Curtis, in his first public pronouncement in more than two days, repeated that he has done nothing wrong.

"I've done a lot of -- damn good for this community,” Curtis said in a brief phone interview with Columbian Editor Lou Brancaccio Thursday morning. “I am not the criminal here.”

Curtis, 48, resigned his state representative position Wednesday afternoon, only slightly more than 48 hours after becoming embroiled in a sex scandal that includes allegations that he wore women’s lingerie and offered to pay a 26-year-old male gay porn model $1,000 for unprotected sex.

Curtis, a married Republican who lives in La Center, had represented portions of Clark and Cowlitz counties in the Legislature for three years.

Since news of the rapidly unfolding scandal first broke Monday morning, Brancaccio is the only journalist to speak with the now disgraced former lawmaker.

"Richard didn't say much, actually,” Brancaccio said following their brief phone conversation at 10 a.m. “He's all lawyered up.”

Curtis said his attorney, John Wolfe of Seattle, has advised him to say nothing more publicly while there is still a chance he could be charged with solicitation in Spokane Municipal Court.

"He said if I spoke publicly, he would drop me like a hot potato," Curtis told Brancaccio.

Curtis said he realizes he needs to explain how he could vote against gay marriage and domestic partnerships and have a secret second life, but he cannot discuss such matters until all legal issues have been resolved.

Curtis said he would eventually give a full interview to The Columbian when the time is right.

Curtis spoke to Brancaccio at about 4 p.m. Monday and denied that he was gay or had sex with the man subsequently identified as Cody M. Castagna.

But police reports released Tuesday afternoon indicated that Curtis admitted to having sex with Castagna during an interview with Spokane police.

Curtis told police that he agreed to give Castagna $100 for “gas money” and denied he was offering to pay for sex. He said Castagna stole his wallet after he fell asleep and later threatened to expose his lifestyle if he did not pay him $1,000.

Castagna, however, told police that Curtis offered to pay him $1,000 for unprotected sex and gave him his wallet as “collateral” until he paid the full amount.
 
Embattled Curtis steps down

Ending 48 hours of speculation about his political future, disgraced state Rep. Richard Curtis submitted his resignation Wednesday to Gov. Chris ­Gregoire, effective immediately.

"While I believe we've done some good and helped a lot of people during the time I served in the Legislature, events that have recently come to light have hurt a lot of people," Curtis, a La Center Republican, said in a statement released by the House Republican Caucus. "I sincerely apologize for any pain my actions may have caused."

Curtis, under fire after revelations that he allegedly initiated sex with a male porn model while in Spokane last week, faced pressure from the caucus and the state party to step down. Party leaders were prepared to call publicly for his resignation if he did not agree to resign.

"I am very disappointed by the news reports of the conduct by Rep. Curtis last week in Spokane," House Republican leader Richard DeBoldt of Chehalis said in a statement released simultaneously with Curtis's resignation announcement.

"After discussing this matter with House Republican leaders, he has submitted his resignation, which we feel is best for everyone involved," DeBoldt said. "The troubling details continue to emerge. ... It has become clear that he can no longer effectively represent the constituents who elected him. We pray that Richard and his family have the strength and support they need to meet the personal challenges they face."

"Representative Curtis did the right thing by resigning today, as it was clear he could no longer effectively represent either the Republican Party or his constituents," said State Republican Party Chairman Luke Esser.

"I recognize this is a very difficult time for the Curtis family and the La Center community," Gov. Gregoire said in a statement. "My thoughts and prayers are with everyone involved."



Replacement process

A new round of speculation began at once about who 18th District Republicans will nominate to serve out the second year of Curtis' term. Esser said he has already begun consulting with local party officials in Clark and Cowlitz counties and House Republican leaders about naming a successor. The 18th District encompasses portions of both counties.

The process, set forth in the state constitution, requires that Republican Party precinct committee officers from the district choose three candidates for appointment to fill the vacancy. The two boards of county commissioners then have 60 days to pick one of those candidates to serve until the next general election, in November 2008.

"We are committed to working together with all deliberate speed to see this vacancy filled by an outstanding candidate," Esser said. "The 18th is a strong Republican district, and we are confident that our party will be able to hold onto this seat."

Names circulating in local GOP circles Wednesday included those of Brent Boger, an assistant Vancouver city attorney and unsuccessful candidate for the Washington Court of Appeals in 2006; La Center consultant Ann Rivers; Washougal city council member Jon Russell; and Liz Pike, a candidate for mayor of Camas.

Ryan Hart, vice chairman of the Republican Clark County Central Committee, said he didn't know how fast the party precinct officers would move in nominating candidates to replace Curtis. "I don't think it's going to happen within the next few weeks," he said.

Former Republican state senator Don Carlson said he hopes the party moves more quickly.

"You can't wait until January to have the person get started," he said. "Since (Curtis) was good enough to resign today, they need to meet as soon as appropriate under the bylaws."

Carlson, who now works as a lobbyist for retired school employees, said Curtis was an exemplary legislator.

"He served the citizens of his district thoughtfully, with care. He attended meetings regularly and he would always be willing to receive me cordially and listen to my concerns. I am sorry about the tragedy for the family and for himself. But mistakes were made and one has to suffer the consequences."



Revelations hastened end

Spokane police records released Tuesday revealed that Curtis admitted to having sex with 26-year-old Cody Castagna, a gay porn model he met in an adult video store and brought back to his hotel room while he was attending a GOP strategy session in Spokane last week. Curtis later asked for help from a Washington State Patrol officer, saying he was a victim of extortion after Castagna took his wallet and refused to return it unless Curtis paid him $1,000.

Castagna told Spokane police that Curtis offered to pay him $1,000 for unprotected sex. Curtis, however, told police that he offered to give Castagna $100 for "gas money" and never offered to exchange money for sex.

According to the police report, Curtis told one detective that he regretted reporting the alleged extortion because it would become public and spell the end of his marriage and his political career.

Neither Curtis nor his wife, Deborah, was at their La Center home Wednesday afternoon when news of the representative's resignation was announced.

In his statement, Curtis said, "This has been damaging to my family, and I don't want to subject them to any additional pain that might result from carrying out this matter under the scrutiny that comes with holding public office."

Sarah Davis, a 21-year-old Portland resident, was the only person at the house. She said she didn't know where Richard Curtis was and that Deborah Curtis was staying with family. She said she had known the Curtis family for about 10 years, ever since Curtis coached her Little League softball team.

"I have known him for so long, and he has helped me through so much," she said. "I even lived here for a little bit when I was in need. Deborah welcomed me into her home, and it's just really tough to think she's going through all this."

Curtis' legal troubles might not be over. He still could face a misdemeanor charge of solicitation for prostitution if Spokane officials decide that Castagna's story has merit.

Howard Delaney, Spokane city attorney, said he will review the case for possible charges only if he receives a request from the police department or the county prosecutor's office.



Story goes national

The salacious revelations about Curtis' secret life contained in the police report, coming on the heels of revelations about U.S. Sen. Larry Craig's alleged solicitation of sex from a male undercover police officer in a Minneapolis airport last summer, attracted national coverage Wednesday.

The Columbian's editor, Lou Brancaccio, the only journalist Curtis has spoken with since the story broke, was interviewed about the scandal Wednesday on CNN. On Monday, Curtis denied in an interview with Brancaccio that he was gay or had had sex with "a guy."

Gay-focused blogs have had a field day with the Curtis story. Dan Savage, a gay sex columnist for the Seattle alternative weekly The Stranger, professed shock at the explicit details contained in the police report.

"Curtis, hoping to keep this whole thing quiet, called the police himself," Savage noted with amazement. "And when the police asked him what happened, he told them everything."

Posts on the site ranged from G-rated to obscene.

"Oh, the web of deceit that Curtis has spun all his life finally catches him and lights him up like a Christmas tree for all to see," said one post.

"I think it's time for the GOP to rename itself the Gay Old Party and just admit who they are," said another.

Said a third: "This whole thing makes Larry Craig look almost angelic."

Claims wallet stolen

Curtis was in Spokane last week to attend a retreat for Republican lawmakers to plan for the 2008 session. It was an official legislative event, which means those who attended are eligible for state reimbursement of a portion of their expenses.



State reimbursement

For events in Spokane County, the state reimburses legislators up to $77 per night for lodging and $49 per day for meals, said Sue Adamich, senior financial coordinator for the Washington House of Representatives. The state pays the standard federal mileage reimbursement rate of 48.5 cents per mile.

House Republican Caucus spokeswoman Lisa Fenton said that for last week's gathering, some members chose to stay at the Red Lion Hotel at the Park and some stayed at the Davenport Towers Hotel. Curtis opted for the Davenport.

The corporate rate at the Red Lion at the Park ranges from $150 to $191 per night, according to the hotel's Web site.

Rooms at the Davenport range from $235 to $599 for the honeymoon suite.
 
I wonder when would Curtis SHUT UP and deal with his mistake?!

He used the Gay Culture just for sex, then vote against it, he's a weird. Glad that the government demand him to be silence.

With all of the political sex scandals that's going on lately, it's beginning to make me wonder whether these people ran for political office so they could do something for the people or just to get a political position and then do something bad to get attention. :dunno:

Curtis is a jerk! I personally don't care who the man has sex with, but to particiapte in the gay lifestyle and then vote against issues such as gay marriage is hypocrtical, and I can't stand hypocracy! He's a dishonest fake. Thank God he has been forced out of office!
