More than 4% of Death Row inmates likely innocent

Essentially, this is an estimate. This can not be factually set in stone determined regardless. Personally I feel 4% is a rather high number. Not to mention this study is using numbers back from the freaking 90's. With the way forensics has advanced these days, I find it highly unlikely many innocent people are convicted and sent to death row these days as in previous times.

Forensics are not used in court because each side presents it's own version of science.

I would think that the ones that have already been exonerated were those who were convicted and jailed long before the 1990s and more recent advances in forensics technology. I too think the number is high and more of an estimate than anything else. There's a lot of factors that go into determining a person's innocence or guilt.
 
I watch a lot of InvestigatedID...and noted that over 6,000 people have been guilty of their crimes, but Prosceutors were not able to prove it....lack of evidence and "reasonable doubt".... and to me, 4% isn't too high. Even when the criminal is found guilty...and goes to prison...he's always "innocent" in his own mind.....All of those inmates will state..."I didn't do it!".
 
the problems you have is they get chop after 10years or so when convict has cleaned up his act off drugs got jesus and education etc and become the man or woman they should have been,i myself find it hard and bit cruel,one thing sharia law right on is give relatives the right say what happens

All inmates get "religion" when they are incarnated...sooner or later, they are praising Jesus.

Exactly... 100% every time... They get in there and boom... that's what they start screaming and shouting.

As I said, 4% is substantially high.

As far as forensics are concerned, they are out there not to go against a person in particular, they are out there to find out who did or didn't do it, period. They are given a few peoples DNA, prints ect to compare various things to and they don't have a clue who these people are. If person A's blood is at the scene and their prints are on the bloody knife well guess what? That's what forensics does. Yes, each side gets a chance to contribute ADDITIONAL forensic information, but the general crime scene forensic information / investigation is out to find who did it, not to prove one particular individual guilty or innocent. They have no clue who did it at the time, they're just looking for an individual.
 
Evidence is allowed by the judge to trial. People are very rarely handed a death sentence on cases without enough mitigating evidence. Life sentences sure but death sentences go through massive appeals and not enough evidence could be raised...

Exactly... it's not like they hand out death like all you can eat buffets hand out free bread... :roll: Not like they actually follow through with it next month either... it takes forever for death row inmates to be killed! :roll:
 
Right, some of the DA are pressured to put wrong people away. This not only destroys the life of the innocent people but the grieving families that does not get any justice they seek for. Really sad!

Evidence is allowed by the judge to trial. People are very rarely handed a death sentence on cases without enough mitigating evidence. Life sentences sure but death sentences go through massive appeals and not enough evidence could be raised...
 
Exactly like Calvin and Mew pointed out. That PBS documentary sounds more anti-death penalty...

If someone's bitemarks and DNA are under a victim's fingernails (like fighting your killer), it's very likely that's the killer. That's why capital punishment cases are a case by case basis. Some people here on the forums need to spend more time studying the entire criminal justice system instead of watching Forensic Files...

they have found that dna can lie...I find it hard I am dead against capital punishment all you doing is giving him the final curtain which we all do but he going to die in comfort good people die awful deaths.
saying this I know I hypocrite because if it happened to my loved ones I proberly want death penalty,maybe it should be left to next of kin
