COEUR D'ALENE, Idaho (AP) — An Idaho man charged with slapping a toddler on a Minneapolis-to-Atlanta flight made an initial appearance in federal court Tuesday.

Joe Rickey Hundley, 60, surrendered to federal agents and then stood before U.S. Magistrate Judge Mikel H. Williams, who appeared via video at the federal courthouse in Coeur d'Alene, Idaho.

Hundley, of Hayden, Idaho, was released by the magistrate on a $10,000 unsecured bond.

As conditions of his release, the Hundley cannot drink alcohol or possess firearms and must surrender his passport. He cannot travel outside of Idaho, eastern Washington state, or the northern district of Georgia, where the case will be tried.

Hundley is accused of slapping the 19-month-old boy during a Feb. 8 Delta Air Lines flight. Hundley has been charged in Atlanta with simple assault. His attorney says he will plead not guilty.

The charge carries a maximum penalty of a year in prison if Hundley is convicted.

Hundley was president of Unitech Composites and Structures, an aerospace company in Hayden. But he was fired last weekend by Unitech's parent company, AGC Aerospace & Defense, because of the in-flight incident.

There was no answer at Hundley's home when an Associated Press reporter knocked on the door Tuesday. He has an unlisted telephone number.

The boy's mother, Jessica Bennett, 33, told the FBI their flight was on final descent into Atlanta when her son started to cry. Hundley "told her to shut that (N-word) baby up," according to a statement from an FBI agent. Bennett said Hundley then slapped the child in the face, scratching the boy below his right eye and causing him to scream even louder.

Bennett has said Hundley appeared intoxicated, became increasingly obnoxious during the flight and complained her son was too big to sit on her lap.

Bennett has said she was shocked by the racial slur. She and her husband are white, while the child, Jonah, whom they adopted, is black.

Scary that he lost his job already. Where was the trial? Presumed guilty? If he somehow avoids conviction, look out.

I really see no reason to have a trial , there was an air marshal on the plane and he saw the whole thing happen. The baby started to cry when his ears where popping and is guilty of nothing . I think the airline was negligence for allowing a drunk passenger on the airplane and I hope the guy was not served more drinks on the plane. The guy hit the baby and he is guilty of abusing a child. Case close! I know innocent to proven guilty but come on this is a baby and what harm could he had cause the man??
 
We humans have to deal with a lot of nuisences when taking public transportation...buses, cabs, subways, etc., even planes.....

Slapping a baby??...because it was crying and perhaps in pain??...No matter the color....And that man made a racist remark....Feel they should have just opened the Hatch and threw the man out into the air!

...Let him fly on his own...And the man was 60 years old...not some impatient teenager and drunk to boot....Feel the airline should be responsible also.....

No telling what I would have done if some drunk man slapped my own baby.

This somewhat happened to me as a kid but at a dentist office by the actual dentist..long story short he isn't a dentist any longer

Welcome to America! I hope you are never accused of something, and the people cry out "No need to try this case. Guilty!"

I think the guy is going to look like a complete asshole if he want to take this to court. What is going to be his defence for hitting a baby because he was crying ? The court should make the guy pay for the time in court . I have no use for people that abuse babies and kids! I hope the baby parents sues the pants off the bastard.

Poor child. He was probably crying because his ears hurt from the pressure of high altitude and descending. He didn't deserve to be slapped. The guy should be charged with child abuse!
