Man Accused of shooting on a Dare

UPPER DARBY, Pa. -- Michael Dibattista was scheduled to appear in court for a preliminary hearing Monday morning on charges that he allegedly shot his best friend on a dare.


The shooting allegedly took place at DiBattista's house in the 500 block of Midvale Road in Upper Darby, Pa., on May 4.

Police said the whole thing started with a dare.

Investigators said that DiBattista, 21, and his friend, David MacNeal, 21, were playing video games and watching television when DiBattista took out MacNeal's handgun, loaded it and held it to MacNeal's head.


MacNeal then allegedly dared DiBattista to pull the trigger and investigators say he did.

DiBattista says that he thought the safety was on when he pulled the trigger.

DiBattista has been charged with criminal homicide, murder in the first and third degree, aggravated assault, recklessly endangering another person, and possessing instruments of crime. His attorney claims that, at most, DiBattista should only be charged with manslaughter.
 
what a stupid ass person this is why I support handgun laws and think that people should not be allowed to have guns at home!!

i would never hold a gun up to someones head...period....
i wouldnt even point a gun at someone..unless it was in self defense

people have the right to have handguns...guns dont kill people........people kill people...............if someone has a gun or 2 at home...they need to be smart enuff to keep them away from children..and not use them in a reckless manner.
 
Jeez... he'd have better luck playing Russian Roulette!
 
I never point a gun at anyone even if it's unloaded unless under threat. I always assume the safety is off and that it is loaded.

I got upset at an offduty police officier who pointed a handgun down at my legs when he was just looking thru the barrel when it was even partly disassemblied. He said that I was wearing a white pair of pants which made it easier for him to look thru but I didn't care..I got pissed off and threated that I'll bushwhack him.
