The state of Texas is taking a big step in the fight to protect the unborn. Lawmakers have filed what is called the “Coerced Abortion Prevention Act” making it a class A misdemeanor for anyone to coerce a pregnant woman or minor into having an abortion. The Department of Family and Protective services would be called and all parental rights would be terminated under title 5 of the Texas Family Code. This would also apply to a conservator or guardian as well. The Texas Family Code would be modified to add “coercing or forcing a child to have or seek an abortion” as a form of child abuse.

Bill HB 1648, filed by Representative Molly White, requires the abortion clinic and the doctor to screen the patient for any evidence of coercion. Before the procedure is to begin, the doctor is to inform the patient that no one can coerce her into having an abortion and that an abortion will not take place unless she is giving her consent verbally and voluntarily. The employees of an abortion clinic are instructed to inform the doctor if they gain knowledge of any woman being coerced into an abortion that is against her own will.

The patient is given reading materials prior to the abortion stating that it is a crime to coerce any woman into an abortion. The women must sign a form that the abortionist has given her the required reading materials explaining coercion. If the woman claims she has been coerced into aborting her child, she will be escorted into a room where she will have access to law enforcement numbers, pregnancy resource centers, hotlines, and even a confidential phone line. An investigation will follow either by law enforcement or Child Protective Services and a 72 hour waiting period before the woman can have the abortion.

NARAL Pro-Choice Texas legislative council , Susan Hays suggests that this is just another restriction that Texas Reps want to put on abortions saying it’s, “creating a problem where none exist to push yet more abortion legislation in Texas that is not needed.” According to statistics on Molly Whites State Representative website, coercion is a common problem. Studies have shown that a high percentage of women when surveyed after they have had the abortion were coerced. In 1992, a study was done by the Medical College of Ohio, stating that at least one-third of the women who reported having an abortion were coerced. White is the founder of “Women for Life International” and publicly speaks about her own experience with abortion and the effects it has on a woman.

If a child is a minor, do the parents have the right to discuss and even discourage whether their daughter should have an abortion? Doesn’t there need to be parental consent? Does this give the state too much power over an issue that is private for many families allowing government to possibly wrongfully accuse a parent of abuse? Who defines what coercion is in this situation? These are just a few questions that could be raised as an issue that may be seen as a very thinly veiled line between trying to be a parent and actual child abuse.

More and more adult decisions are being laid upon children without consulting with the parents. That includes whether a child can have an abortion or the morning after pill without the consent of a parent. This is a dangerous practice either way as our children do not belong to the state and last checked, good nurturing parents have the right to decide what is best for their child, not the village.
