I couldn't figure out what you were trying to tell us about from your title. It turns out to be about a home invasion. Any chance you could get it changed in your title? You might get more response.
 
Seemed obvious to me he was casing out the house...knocking to see if anyone was home...then going around to the back also....:hmm:...darn tootin' if somebody came to my door knocking and knocking and I didn't want to answer, then going around to the back door and peeking in the windows?...

But it was my understanding that the culprit had to be "inside" the home....:hmm:...and the shooting would be justified.

That's the thing..."...he was making entry..." when she "..shot through the door..." before I was ever handed a weapon I was taught to fully identify your target and what is beyond your target. Shooting through a door results in things such as hitting innocents, your spouse, or some kid across the street. Not only was he not in the house but he was fleeing at the time he was struck... just seems wrong that this shooting is acceptable....

The possibility you could get killed has always been an occupational hazard of criminality. On the other hand, the person in question could always change his/her profession.

Laws should never favor the criminal.

I think it is true in most legal jurisdictions that you can't shoot someone fleeing from you.......
 
In Texas, its perfectly fine and legal. Texas CAN shoot first before asking question. Its been in the book for years.

The possibility of getting killed is there for almost anything ... but at the same time this woman could have hurt more than just the man breaking into her home. Shooting through a door should not be acceptible...
The laws should not favor criminals...but at the same time "innocent until proven guilty" is reduced to empty words if people are allowed to shoot at shadows.
I am all for gun ownership and self protection, but lethal options should be a last resort, for it is a final solution, not a first one...

Truth...that is what got me on this story...it was a cleared shooting.... why? I do not think she should be jailed but at the same time this should not be acceptable...

The linked story states:

"As he was making entry, the homeowner started shooting rounds through the door"

That's not fleeing.

He could have turned just at the moment the homeowner fired, thus resulting in back wounds.

I don't know the configuration of the house. It's possible the back door had a window in it, or the homeowner could see thru other windows to see who was breaking in. :dunno:

These stories never have enough details.

In fact, anyone who gets shot as a result of a crime, by anyone, is the fault of the criminal of that crime.

In truth, I do not think first about either the woman nor the criminal...it is the innocent bystandards that can and do get hurt by wild shots...

If the guy was really looking for his 'lost dog' why did he going into hiding instead of getting help right way?? I think the home owner was right in trying to protect herself.
