(NEWSER) – "You can't just go down the road eating a hamburger." That, Madison Turner says, is what a Cobb County, Ga., police officer told him "three times" after pulling him over last week for distracted driving. Turner had been enjoying a double quarter pounder with cheese from McDonald's when the officer stopped him and "explained to me that he observed me eating a burger for 2 miles," Turner tells WSB-TV. On the ticket the officer gave Turner, he wrote, "eating while driving." The Alabama man has a Feb. 3 court date.

As for the law Turner allegedly broke, it states in part that a driver "shall not engage in any actions which shall distract such driver from the safe operation of such vehicle." A traffic attorney who's not involved with the case notes that he typically only sees such charges if an accident has occurred. "Maybe if you had a giant pizza in both hands and you weren't holding the wheel," he muses, then such a rule might apply. "Or maybe if you had a watermelon, half watermelon and you were just diving into it holding it with both hands."

If that's the law, then you just can't go down the road eating a hamburger. He's got one hand on that burger, thinking about not spilling anything on his clothes, getting ready for the next yummy bite, not concentrating on his driving at all. Fine him, it's as bad as cell phone or texting!

I actually am more alert when I'm doing something that might distract me while driving, such as eating. And I know that I won't hesitate to drop the food if I need to. I dont' eat while driving much, but I do it safely when I do.

Never knew it was the Law....and whenever I order FF...I like to eat 'em while they are hot....Never knew of anyone that got a ticket like this.

Well, french fries are a little easier to eat while driving vs a hamburger with lots of stuff on it (I eat my plain).

Have seen plenty of drivers distracted by reading newspaper, shaving, eating, fibbling with the radios, you name it.

Yes...even ladies applying makeup....on the phone....smoking, drinking a soda or coffee at the same time while driving....

Friend gave me a ride once and she dropped her cigarette on the floorboard, and she bent over trying to find it!....I was freeking out and grabbed the wheel. Long story short, I never rode with her again.

No surprise, I prefer to drive in DC metro because nobody care about you.

I saw a guy eating and talking on the phone while driving , he was using his knees to drive. I kept far away from the car.

If I amnhungry and on the road, I grab the one of the granola bars from my glove compartment. I tried eating tacos while driving...never again. However, getting ticketed for it is new to me. Lol

I am usually juggling bowling pins while also texting while driving through Cobb County. :hmm:

Ok, I'll remember not to eat a hamburger.

This guy must be sooo hungry. I don't know anyone got ticketed for eating while driving. Weird.
