SAN ANTONIO (Reuters) - An El Paso man faces up to 18 months in jail after pleading guilty to urinating on the Alamo, the iconic structure seen by many as the symbol of the Texas spirit.

"The message is, 'don't whiz on the Alamo,'" Bexar County District Attorney Susan Reed, said in a statement that added she would oppose any request for probation.

Daniel Athens, 23, pleaded guilty in a San Antonio court on Tuesday to the felony of Criminal Mischief of a Public Monument or Place of Human Burial, which carries a punishment of up to two years in prison.

Lawyers for Athens are working on a plea bargain with prosecutors, who are seeking 18 months in prison and drawing a line in the sand for a sentence that includes jail time.

Athens was arrested in April 2012 after an Alamo Ranger, one of the police officers who guard the state's No. 1 tourist attraction, saw him relieve himself on the 260-year-old limestone facade of the building.

As part of a plea deal, Athens will have to pay $4,000 to repair any damage he caused.

The Alamo was constructed in the 1750s by Spanish colonists as a chapel to bring Christianity to the native peoples of what is now Texas.

It is best known for the 1836 battle between the Mexican Army and Texas settlers fighting for independence from Mexico.

The Alamo has suffered its share of urinary insults over the years, the most famous was from British rocker Ozzy Osbourne, who in 1982 urinated on the Cenotaph, a memorial to the Texans killed at the battle.

Osbourne was banned from the city by the city council, a symbolic move that was later rescinded after he donated $10,000 for the Alamo's upkeep.

Don't let Hoichi see this......

So much for the same treatment for the Red Rock or Boulder in Utah, just like The Alamo. Which mean gotta show respect.

Oh wow, peeing Abraham Lincoln Memorial = felony.

Yes, I don't think peeing Alamo is worse than broken boulder that fell down to ground from top.

fascinating

Yes, it is, because it's a memorial to people who died there.

So guessing you're gonna think twice before peeing on the Alamo, huh?....'Course if you've got the time for jail (again)...try it...along with a couple of g's to pay off the fines...then deal with the cons who do respect the Alamo....

The State of Texas would surely kick you out...oh my!...2 offenses and the good ol' USA won't have you here...permanently.

Ok, my bad, I'm wonder about what diehardbiker would think about this news.

If urine causes harm to surface of memorial so yes, it is bad as broken stone, or more worse.

The recidivism rate is very high in US so it could possible for him goes back to prison.

for those who really wish to know.
my user name is Japanese. i am an Italian citizen, and Canadian citizen with a British entitlement to the right of abode in the Uk. Thus i can live and have lived both in italia and the Uk, as well as the republic of Ireland. to wrap up some other comments in other posts that some may have an interest in knowing. i was married in mexico and have lived in mexico a number of years, colonia coapa mostly but colonia las aguilas as well federale districto. the only countries that currently wont let me enter are France (paris was fun, though the French didn't seem to enjoy me as much as i enjoyed them) and the U.S.
i spent a good part of my life in the states and due to being a convicted felon (many moons and and some chicks ago) am refused entry. after serving my bit, i was removed, though rather politely from the united states and was transported on the American tax payers dime to canada.
as for returning to america. (reaches hand out of window clutching for the old glory)

unless i become filthy rich, and or shag a presidents daughter. thats not gonna happen due to the fascists bastards running the place

i wouldn't piss on the alamo. unlike some here. i understand the difference between a place where men died and were killed as opposed to a rock, in the bush.

your worship of authority and my lack of it, has no bearing whatsoever on why i wouldn't piss on the alamo or any war memorial in any country. America or Canada or otherwise

its my respect for the fallen. and their sacrifice, in both and all sides of any slaughter or war which is the reason why i wouldn't do it. and have not.

hope for those very interested in me, i have put the above to rest

given my current career, and my current state of well being both spiritual as well as financial, given how far i've come and how happy i now am
