(CNN) -- Frank Hatley spent the past year in jail for being a deadbeat dad. But there's one problem -- Hatley doesn't have any children. And the "deadbeat" label doesn't fit the 50-year-old either, his supporters say.

After a hearing, Hatley was released from the Cook County Jail in south Georgia Wednesday afternoon, with the help of the Southern Center for Human Rights.

Superior Court Judge Dane Perkins ruled that Hatley was indigent and should not be jailed for not being able to make child support payments. Perkins postponed a decision on whether Hatley should have to make any more back payments on child-support for a child who is not his.

In June of last year, a judge ordered Hatley to jail for failing to reimburse the state for public assistance that was paid to support his "son," who, as the court was aware, is not actually his son.

Hatley's attorney Sarah Geraghty, who filed a motion for his release, called it a case of "blatant unfairness."

Hatley is a hard-working man who demonstrated his desire to pay what the court said he owed, even making payments from his unemployment checks, Geraghty told CNN.

On top of that, "the state has no legitimate reason to pursue Mr. Hatley for child support -- he doesn't have any children," she said.

The story dates back to 1986, when Hatley had a relationship with Essie Lee Morrison. She became pregnant and gave birth to a son.

Morrison told Hatley that the child was his, but the couple ended their relationship shortly after the boy's birth, according to court documents. The couple never married and never lived together, the documents state.

When the boy turned 2, Morrison applied for public support for her son. Under Georgia law, the state can go after the non-custodial parent to recoup the assistance.

For 13 years, Hatley made payments to the state until learning, in 2000, that the boy might not be his biological son. A DNA test that year confirmed that there was no chance he was the father, according to court documents.

Hatley returned to court and was relieved of any future child support reimbursement but was ordered to pay more than $16,000 that he had owed the state before the ruling.

Latesha Bradley, an attorney who represented Hatley in that hearing, told CNN the argument for keeping Hatley liable for the back payments was that he had signed a consent agreement with the office of child support services. The court agreed that Hatley had to comply with the consent agreement for the period that he believed the boy was his son.

Court documents show that Hatley for the most part continued to make payments. He was jailed for six months in 2006 for falling behind on payments during a period of unemployment, but afterward he resumed making payments and continued to do so even after he lost another job in 2008 and became homeless, court records state.

Last year, he again became unable to maintain the payments and was once again jailed.

The circumstances of Hatley's arrest didn't feel right to many, including Cook County Sheriff Johnny Daughtrey.

"I knew the gentleman's plight and didn't know how to help him," Daughtrey told CNN.

About two months ago, when attorneys from the Southern Center for Human Rights visited his jail, Daughtrey alerted them to Hatley's case.

What a blatant miscarriage of justice!!!...The mother of the child should be the one jailed....and the biological father should be found and jailed also!

South Georgia should be ashamed this happened in their town/city! Bunch of greedy, money-hungry SOB's!....Hopefully, a good lawyer will take his case pro bono....and sue the city. This man deserves a medal, not a jail cell!

If I were a guy I would never touch a single pregnant woman without a decent job with a 10 foot pole! Those are the ones that try to claim the latest boyfriend as being the baby's daddy. Also if you ever meet a single mother with three children, all by different daddies, and unemployed and receiving government assistance, you should run screaming the other way!

A cop is trained to shoot first and ask questions later. This sheriff knew exactly how to help Hatley and REFUSED. Daughtrey is as part of the problem as the legal system that arrested this man without proof. If I was Hatley, I'd demand Daughtrey's job and every person in contact with this case, including the judge. I wouldn't stop suing everyone and no one will claim immunity from that suit.

The sheriff is only doing this to cover his own back side because he knows very well that a jury will believe him when he tells them he contacted the Southern Center for Human Rights.

Sheriff . . . you're going down with the rest of them!

I thought they were supposed to establishing paternity to prove if he's the father or not before a court can set or change support order, if the court knew he wasn't the father then why did he paid child support in the previous past? I think the mother should have gone to jail because if she is unsure who's the father of the baby, she should have gotten a paternity test done.

I agree.. The mother is the one that was dumb enough to sleep around, and not know who the actual father is. She should be charged for it.. Since she should be the responsible one, to know who she conceived the child from.


Not some innocent sap that comes along.

a major injustice, for the poor sap that perhaps, signed the Birth Certificate.
 
Let's go easy on the mother, guys. There are two sides to every argument and let's not forget, there's a father out there that is not standing up to his own responsibilities in this. I don't buy the argument that someone will say that how is he to know he's got kids . . . I'm not even going to explain this one to you.

The fact still remains that a man had been jailed for not paying child support for a child that wasn't his to begin with and that he was coerced into taking responsibility for. He is the innocent victim on this, not the child. He should come out of this case smelling like a rose and unbelievably wealthy.

The justice system failed him and made him pay in every area of his life, including his reputation. I think I would even go so far as to say he should sue that woman who did this and any family member of hers that was involved. Clearly the judge and the DA's office did very shoddy work. I wouldn't stop suing them and take my story on every talk show imaginable and publish names to ensure these people who did this to him will not be able to find employment again in that profession.

Might I add that if this man was caucasian, he would never have been arrested and the paternity test would have been done immediately.
 
The mother should have not let that man paying the child support, anyway.

They both are the victims, a child doesn't know it's father, he may thought that the guy (Hatley) who was paying child support was his father. Hatley was told that he was the father after she gave birth to her son, don't you think she told the child the same thing? I believe she did during those 13 years that Hately had been paying child support. Hately should sue the mother for all that support that he had paid all those years.

I know this isn't exactly related to the story, but it made me remember this story that my ex-husband told me about a co-worker of his who had been paying child support for 18 years for his daughter. When she graduated, that was when his daughter's mom told him that the child wasn't his, and had known it all along and never told him. I can't imagine the rage that guy must've felt! :shock:
 
That guy deserves a medal after what he has been through!
 
The man should get the money he paid back from the state, and the mother should be required to pay the court fees and testing, as well as the the money that the state had to repay this man.

If any man is wise enough, he will ask for a paternity test before signing ANYTHING!

Some men honestly are sincere and believe in the women they were with. They probably didnt even think about asking for a paternity test.
