The battle of the boobs could be decided by a simple question: Who’s watching the bottom line?
State Police descended on Times Square Saturday as the topless painted ladies and their male managers who have been preying on tourists for tips were questioned on whether their basic business practices are on the up and up.
One state officer was armed with a clipboard and grilled the women, trying perhaps to find a way to kick them out of the Crossroads of the World once and for all.
Sources said the police were working on behalf of state Labor Department investigators looking into the jiggly panhandlers.
Gov. Cuomo, in a phone interview with the Daily News Friday said the answer to the topless terror is simple: “either the activity is legal or its illegal.”
Cuomo said if the bare-breasted buskers are operating as a business, then the state needs to ensure they are in compliance with tax laws and workers’ comp requirements.
The investigation comes as city and state politicians vie for a solution that would rid Times Square of the topless tip seekers after the Daily News brought the issue to light last week.
Mayor de Blasio created a task force and suggested eliminating the pedestrian plaza at Times Square would purge the area of the mammary menaces. On Friday, State Sen. Ruben Diaz said he planned on proposing legislation that would bar both men and women from going topless.
While a 19-year-old New Jersey man dressed as Spider-Man was arrested for aggressive solicitation, according to police sources, the latest near-naked lady to cause a stir at the tourist mecca was 69-year-old Clare Hogenauer.
“I’m doing this to say that we all have the same right to be topless,” Hogenauer said.
