Alleged away instant message offered liquor to minors

BELLEFONTE - A Penn State student may go to trial on charges stemming from an alleged sale of a bottle of spiced rum to an undercover officer.

Simeon J. Lucien, 19, of 904 Sproul Hall, University Park, was charged with committing unlawful acts relative to liquor, alcohol and liquor licensees, criminal attempt, selling or furnishing liquor to minors, and a summary after university police got a tip about Lucien's AOL Instant Messenger account.

According to police reports, police found that his account carried an "away message" on Feb. 20 saying he could provide alcohol for a fee. An away message informs other Internet users that the person is unavailable to converse using the instant message program.

The away message included two phone numbers, one of which was to his dorm room. Police looked up the phone number and found that Lucien lived there.

Police found another away message on Lucien's account on March 20 that also said he could provide alcohol. Part of the text of the message read: "U wanna drink?... U tell me what u want, gimme the cash, and I'll get you the bottles like lickety split, yo." The message included his room number, police reports show.

Three days later, university police officer Adam J. Sucheski sent an instant message to Lucien asking him to obtain a fifth of Captain Morgan spiced rum. Lucien agreed to purchase the liquor and charged Sucheski $20. The officer later picked up the bottle of Captain Morgan at Lucien's room and gave him the money.

On March 25, court records show, Sucheski again went to Lucien's room to pick up another bottle of Captain Morgan. This time, the officer mentioned that he was under 21, police reports show. After Lucien gave it to him, Sucheski identified himself as a police officer and requested Lucien's ID.

Lucien was arraigned before District Justice Carmine Prestia on April 24 and waived his right to a preliminary hearing Wednesday. The case will go before a judge.

Serves that bastard right! Oh well... our freedom of speech isn't free any more!
 
Damn....sounds like something I would do on my job. I love getting people busted. LOL
