I was about to be on my way to deliver a particular bike to someone when someone else stopped by to look at some bikes. The person who stopped by asked me about a particular bike. I had to tell them I already had a buyer for it. They begged me to take a deposit. They'll pick it up tomorrow. I had to tell them I had a deal. I know, first come, first serve. However, look at this situation.

I'm not going to make someone wait at Starbucks while someone else stops by to buy a bike. I'm not going to make person sit at Starbucks, then tell them sorry, just a minute ago, someone else came and bought the bike.

If I had deal to meet person at 8 pm at Starbucks and someone else came at 3 pm wanting the bike, then I wouldn't mind selling it to the person who came at 3 pm and then cancel 8 pm meeting.

But here, I was about on way to deliver the bike. I'm not going to pull up a last minute snub like that.

what if he's offering to pay you more than first buyer? :deal:

No, I don't think that is the thing to do.

I would do this;

If the bicycle's origin price is $100.

$150 bike sell to that person at 3pm

if not,

$100 to that person at 8pm.

It's fun to gamble sometimes. ;)
 
why dont you contact them if possible and see who pay the most explain position

I would not promise someone a bike and then back out of the deal.

I agree that Mr. Bicycles did the right thing (in this case), but given enough time, as he stated, he would have chosen a different course and I disagree with the course he would have chosen. If he wants to use a bidding system then he should clearly say, "If someone offers me more in that time, I'll give the bike away and cancel." The guy who was promised the bike doesn't really care what time it is, he has a promise to get the bike.

oral contract doesn't mean anything. that's why it should be written on paper and signed.
