Two dead, including gunman in shooting outside Empire State Building

[Updated at 11:26 a.m. ET] A disgruntled former employee of a business inside the Empire State Building shot a former coworker in the head in a dispute outside the building, New York Police Commissioner Ray Kelly said.

As suspect Jeffrey Johnson tried to flee the scene, he pulled a .45 caliber pistol on two approaching police officers, who opened fire on him. Nine people were wounded or grazed by gunfire in the crossfire, Kelly said.

"Some may have been accidentally shot by police officers," Kelly said.

[Updated at 11:08 a.m. ET] The Empire State Building is fully operational after ten people were shot outside the popular tourist destination this morning, leaving at least two dead.

Building representatives released a statement saying the New York Police Department is concluding its investigation that occurred shortly after 9 a.m.

guns should be banned
The bad guys don't obey gun bans. Only the good guys do.

Have you noticed that most places where shootings are where guns are banned or heavily restricted? Guns are banned from most schools, theaters, and religious buildings, and very restricted in NYC. Yet, shootings occur. The shooting at Ft. Hood was possible because none of the victims (trained soldiers) were allowed to carry their guns with them on post yet the killer had his guns because he didn't obey the rules restricting them.

it is already banned in NYC. it's already illegal to carry a gun in NYC and guess what happened? how's gun ban coming? an epic fail.

in fact.... it is said that some victims who got wounded were shot by cops but I believe most of victims were shot by cops.

I'm not surprised by this because NYPD is notorious for being trigger-happy and shooting till mag's empty just like Amadou Diallo.

lol I don't see how there can be "more" gun bans" when NYC already have a gun ban law. Mayor Bloomberg is a founder of "Mayors Against Illegal Guns" - Mayors Against Illegal Guns and apparently, he's failing at it. His organization is failing at it.

“They returned fire,” the mayor added. A law enforcement official said later on Friday that Mr. Johnson did not fire his weapon.

Police Commissioner Raymond W. Kelly said that nine bystanders had been “wounded or grazed” and taken to hospitals. The mayor said that some of the injured may have been hit by police bullets during the confrontation with the suspect, whom Mr. Kelly identified as Jeffrey Johnson, 58, a former clothing designer at Hazan Imports. Mr. Kelly said that the two officers fired a total of 14 rounds and that he believed that some of the shooting victims had been shot by the officers “based on the number of people shot and the capacity of” the shooter’s weapon.

Mr. Kelly said Mr. Johnson appeared to have no criminal record. He said that Mr. Johnson had worked at Hazan Imports for six years. “During a downsizing at the company about a year ago,” Mr. Kelly said, “Johnson was laid off.” Mr. Kelly said that Mr. Johnson and Mr. Ercolino had filed harassment complaints against each other relating from a workplace dispute.

Mixed feelings...in my city, we seem to average about 2-3 shootings everyday...outright murder, car jackings, shooting into occupied dwellings, etc., etc. Only takes a minute of deep inner rage to pick up a gun and shoot. Even the most law-abiding/sane person is capable of it.

oh my... 2-3 shootings everyday? so that's about 14-21 shootings per week. looks like most of shootings were by thugs with rap sheets.

I said "it seems"...and feel most are drug-related....should have worded my comment to 2-3 shootings a week. Just had another one today, domestic dispute...wife was leaving so the man shot her as she was driving away from the home....nice neighborhood too....yesterday, found the body of a missing man, whose SUV was found in the river, and he had a shot to the head....so you catch my drift......

and bloody glad you did win or our cops be armed and loaded:)...i think the forum is alldeaf not just american deaf, global community.. some years ago not long after 7/7 in london a young man from south america was shot by our cops if memory serves this young man was deaf and unable to understand what was happening and no stopped when requested so shot dead was sad misunderstanding...some of our cops are armed like at airports that fair enough..arm all cops and what happened in ny is the out come...you arm only calm crack shots then accidents are reduced,Stop guns then crime reduced..... american thinking is citizens rights where as in uk and majority of world this no apply

right I know. this tragedy happened in NYC and gun ban did not work.

some years ago not long after 7/7 in london a young man from south america was shot by our cops if memory serves this young man was deaf and unable to understand what was happening and no stopped when requested so shot dead was sad misunderstanding...
yes. I remember that tragedy where a young man was running to subway and cops yelled - stop stop stop but he didn't so the cop shot him because they thought he was a suicide bomber.

some of our cops are armed like at airports that fair enough..arm all cops and what happened in ny is the out come...you arm only calm crack shots then accidents are reduced,Stop guns then crime reduced.....
very simple - people will go to jail if they shot recklessly. The cops can go to jail if the investigation shows that the cops were negligent.

no. it's not that we "think" it's our rights to own guns. It's part of Constitution because we citizens have the rights to bear arms to fight against tyranny and enemies. Look at Switzerland.

You, on the other hand, chose to surrender your ability to defend yourself and that's why your country has police and government to spy on you, monitor everything, and restrict anything however they want. That's not freedom to me.

Even if we ban guns, they're still going to get their hands on them.

If they can't, they will still think of other ways...

That's the psychology of prohibition. The more you prohibit, the more likely people will do it. The more you ban, the more tempting it is.

Not just that but the "concrete jungle" has more hard surfaces and angles for ricocheting, and for sending off pieces of shrapnel.
